RESOLUTION NO. 0 3 - 214
A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CONVEYANCE OF SIX CITY -OWNED
VACANT PARCELS LOCATED IN THE MODEL CITY
NEIGHBORHOOD TO PALMETTO HOMES OF MIAMI,
INC. AS DEVELOPER, AT NO COST, FOR THE
DEVELOPMENT OF SIX NEW SINGLE-FAMILY HOMES
AFFORDABLE TO FAMILIES AND INDIVIDUALS OF
LOW-INCOME, SUBJECT TO THE DEVELOPER:
(1) AGREEING TO PAY THE COST OF ELIMINATING
ALL TITLE DEFECTS EXISTING ON THE PARCELS,
(2) PROVIDING EVIDENCE ACCEPTABLE TO THE
CITY OF FIRM COMMITMENTS FOR PROJECT
CONSTRUCTION AND PERMANENT FINANCING FOR
PURCHASE BY QUALIFIED HOMEBUYERS,
(3) COMMENCING CONSTRUCTION WITHIN TWELVE
MONTHS FROM THE DATE OF CONVEYANCE BY THE
CITY, (4) COMPLYING WITH OTHER TERMS AND
CONDITIONS INCLUDING PARCEL REVERTER
PROVISIONS, AS DEEMED APPROPRIATE BY THE
CITY MANAGER AND THE CITY ATTORNEY, AND (5)
PROVIDING THE ADMINISTRATION WITH A STATUS
REPORT CONCERNING THE TITLE TO THE PARCELS
WITHIN NINETY (90) DAYS FROM THE DATE OF
CONVEYANCE; FURTHER AUTHORIZING THE CITY
MANAGER TO EXECUTE ALL NECESSARY DOCUMENTS,
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY,
FOR SAID PURPOSE.
WHEREAS, a severe shortage of affordable housing exists in
the City of Miami ("City") for families and individuals in the
low and moderate -income range; and

WHEREAS, pursuant to Resolution No. 99-429, adopted
July 22, 1999, the City Commission approved the City's proposed
Five -Year Consolidated Plan (1999-2004) ("Plan") for submission
to the United States Department of Housing and Urban Development
including, as a major component of the Plan, a housing strategy
designed to facilitate the annual creation of 1,000 new
homeownership units for purchase by very low, low and
moderate -income families; and
WHEREAS, the six parcels are located in the Model City
Community Revitalization District and the Model City
Revitalization Trust has confirmed that the development plan
proposed by Palmetto Homes of Miami, Inc. ("Developer") conforms
with the mission of the Model City Trust; and
WHEREAS, Section 29-B of the City Charter, as amended,
allows for the conveyance or disposition of City -owned property
in connection with the implementation of City -assisted housing
programs or projects intended to benefit persons or households
of low or moderate -income without competitive bidding
requirements and fair market value return to the City;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are adopted by reference and
incorporated as if fully set forth in this Section.

Section 2. The conveyance of the following six parcels
at no cost to the Developer is authorized, subject to the
Developer (1) agreeing to pay the cost of eliminating all title
defects existing on the parcels, (2) providing evidence.

homebuyers, (3) commencing construction on the parcels within
twelve months from the date of conveyance to the Developer by
the City, (4) complying with other terms and conditions,
including reverter provisions for each parcel, as deemed
appropriate by the City Manager and the City Attorney, and
(5) providing the administration with a status report concerning
the title to the parcels within ninety days from the date of
conveyance:

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.k

If the Mayor does not sign this Resolution, it shall become
effective at the end of ten (10) calendar days from the date it
was passed and adopted. If the Mayor vetoes this Resolution, it
shall become effective immediately upon override of the veto by
the City Commission.
