WITH ATTACHMENT(S), GRANTING TO PALMETTO HOMES OF MIAMI, INC. ("PALMETTO HOMES"), AN EXTENSION OF TIME UNTIL DECEMBER 31, 2007, IN WHICH TO COMPLETE CONSTRUCTION OF, AND SELL, THE HOME LOCATED AT 821 NORTHWEST 50 STREET, MIAMI, FLORIDA; STATING THE INTENTION OF THE CITY COMMISSION RELATED TO THE CONVEYANCE OF TITLE TO THE PROPERTY LISTED ON EXHIBIT "A," ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE MODIFICATIONS TO THE DEED(S) THAT CONVEYED THE PROPERTY FROM THE CITY OF MIAMI TO PALMETTO HOMES, AND ALL NECESSARY OTHER DOCUMENTS, FOR SAID PURPOSE. WHEREAS, pursuant to Resolution No. 03-214, adopted February 27, 2003, the City Commission approved the conveyance, with title reverter provisions, of six (6) vacant parcels located in the Model City Homeownership Zone to Palmetto Homes of Miami, Inc ("Palmetto Homes"), for the development of eight (8) single family homes; and WHEREAS, due to unforeseen delays, construction on the property located at 821 Northwest 50 Street, Miami, Florida ("Property"), which was conveyed to Palmetto Homes, pursuant to said Resolution, has not been completed as required by the Quit Claim Deed from the City of Miami ("City"), dated June 22, 2005; and WHEREAS, the City Administration recommends granting to Palmetto Homes an extension until December 31, 2007, to complete construction of, and sell, the home located on the Property; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. An extension of time, until December 31, 2007, for Palmetto Homes to complete construction of, and sell, the home located at the Property, is approved. Section 3. It is in the intention of the Miami City Commission that title to the parcels described above and in Exhibit "A," attached and incorporated, shall be deemed to have remained in Palmetto Homes from the date of conveyance, and that the extension of time granted herein to complete construction shall be deemed to have been made as follows: on or before May 31, 2006, with regard to the Property. Section 4. The City Manager is authorized{1} to execute any required modifications to the deed(s) that conveyed the Property from the City to Palmetto Homes, and all necessary other documents, for said purpose. FERNANDEZ 101 CITY ATTORNEY Footnotes : {1 } The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted.
