A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO EXECUTE AN AMENDMENT TO THE SETTLEMENT AGREEMENT
IN THE CASE OF MIAMI-DADE COUNTY VS. THE CITY OF MIAMI AND
SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT
AGENCY, CASE NO. 01-13810 CA (08), IN THE CIRCUIT COURT OF THE
ELEVENTH JUDICIAL COURT OF FLORIDA, IN AND FOR MIAMI-DADE COUNTY,
IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO EXTEND THE REVERTER
DATE FOR BLOCKS 36, 45 AND 56 IN OVERTOWN.
WHEREAS, the City of Miami ("City"), the Southeast Overtown/Park West Community
Redevelopment Agency ("CRA") and Miami -Dade County ("County") entered into a settlement
agreement in Miami -Dade County vs. the City of Miami and Southeast Overtown/Park West
Community Redevelopment Agency, Case No. 01-13810 CA (08), in the Circuit Court of the Eleventh
Judicial Court of Florida, in and for Miami -Dade County; and
WHEREAS, subject to certain conditions and extensions, the settlement provided for transfer of
title to Blocks 36, 45 and 56 ("Blocks") in Overtown if the City and/or CRA had not "commenced
construction of development" on all of the Blocks by August 1, 2007; and
WHEREAS, the parties to the settlement wish to extend the time for commencement of
construction of development on the Blocks; and
WHEREAS, the City Commission wishes to authorize the City Manager to execute an amendment
to the settlement agreement for said purpose;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated herein as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an amendment to the settlement
agreement in the case of Miami -Dade County vs. the City of Miami and Southeast Overtown/Park
West Community Redevelopment Agency, Case No. 01-13810 CA (08), in the Circuit Court of the
Eleventh Judicial Court of Florida, in and for Miami -Dade County, in a form acceptable to the City
Attorney, to extend the reverter date for Blocks 36, 45 and 56 in Overtown.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} if the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
