THE CITY OF MIAMI AND SOUTHEAST OVERTOWN/PARK WEST COMMUNITY REDEVELOPMENT AGENCY, CASE NO. 01-13810 CA (08), IN THE CIRCUIT COURT OF THE ELEVENTH JUDICIAL COURT OF FLORIDA, IN AND FOR MIAMI-DADE COUNTY, IN A FORM ACCEPTABLE TO THE CITY ATTORNEY, TO EXTEND THE REVERTER DATE FOR BLOCKS 36, 45 AND 56 IN OVERTOWN, AND TO PROVIDE THAT COMMENCEMENT OF CONSTRUCTI,ON OF DEVELOPMENT ON ANY BLOCK SHALL DIVEST THE COUNTY OF ANY REVERSIONARY INTEREST IN THAT BLOCK. WHEREAS, the City of Miami ("City"), the Southeast Overtown/P.ark West Community Redevelopment Agency ("CRA") and Miami -Dade County ("County") entered into a settlement agreement in Miami -Dade County vs. the City of Miami and Southeast Overtown/Park West Community Redevelopment Agency, Case No. 01-13810 CA (08), in the Circuit Court of the Eleventh Judicial Court of Florida, in and for Miami -Dade County; and WHEREAS, subject to certain conditions and extensions, the settlement provided for transfer of title to Blocks 36, 45 and 56 ("Blocks") in Overtown if the City and/or CRA had not "commenced construction of development" on all of the Blocks by August 1, 2007; and WHEREAS, the parties to the settlement wish to extend the time for commencement of construction of development on the Blocks and to provide that commencement of construction of development on any block shall divest the County of any reversionary interest in that block; and WHEREAS, the City Commission wishes to authorize the City Manager to execute an amendment to the settlement agreement for said purpose; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated herein as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to execute an amendment to the settlement agreement in the case of Miami -Dade County vs. the City of Miami and Southeast Overtown/Park West Community Redevelopment Agency, Case No. 01-13810 CA (08), in the Circuit Court of the Eleventh Judicial Court of Florida, in and for Miami -Dade County, in a form acceptable to the City Attorney, to extend the reverter date for Blocks 36, 45 and 56 in Overtown, and to provide that commencement of construction of development on any block shall divest the County of any reversionary interest in that block. FERNANDEZ CITY ATTORNEY Footnotes: s{1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} if the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
