Dear Teresita:
On behalf of the applicant Emerald Terrace Limited Partnership, ("Emerald") this letter constitutes an
appeal of the decision of the Zoning Board at its hearing held on March 26, 2007 with regards to the above
referenced Special Exception. Emerald filed a Special Exception to reduce the parking for an Affordable Housing
development.
The Zoning Board granted the Special Exception, however conditioned it upon including 24 additional
parking spaces. This conditional approval was granted despite the recommendation of approval and analysis given
by the Planning Department that the proposed parking was sufficient to meet the needs of the community. The
application proposed a total 144 parking spaces for 124 units, as well as 20,884 sq. ft. of green space where only
11,554 sq. ft. is required. The parking provided was based on extensive research including a report prepared by
David Plummer and Associates, as well as research from the U.S. Census Tract and a .review of the public
transportation for the area. Ali this analysis coupled with the background of the Applicant and its prior projects in
the City of Miami, yielded a need for no more than 144 spaces. Despite this data, the Zoning Board would only
approve the project subject to 24 additional parking spaces and the loss of approximately 8,000 sq. ft. of green
space.
There is no need for 24 additional parking spaces for this project When the evidence demonstrates that 144
parking spaces are sufficient to serve the project. It serves no purpose to provide these additional parking spaces at
the loss of providing additional green space. 'Therefore, we are appealing the decision of the Zoning Board and
respectfully request that the City Commission remove the condition requiring the additional 24 parking spaces.
