MAJOR USE SPECIAL PERMIT
Addendum to Application
Special Permits
March 2007
1) To apply for a Major Use Special Permit, as per Article 17, Section 1701
definition (2), to allow non-residential uses involving in excess of two hundred thousand
(200,000) square feet of floor area,
2) To apply for a Major use Special Permit , as per Article 17, Section 1701
definition (3) to allow a hotel involving in excess of three hundred fifty (350) rooms.
3) To apply for a Major use Special Permit , as per Article 17, Section 1701
definition (7) to allow for any single use or combination of uses requiring or proposing to
provide in excess of five hundred (500) parking spaces.
4) Special Permits:
a) To apply for a Class II Special Permit for development within the CDB
district.
b) To apply for a Class II Special Permit to allow a waiver of the required five
foot setback on lots which have less than two hundred (200) linear feet of
frontage on a given street.
c) To apply for a Class II Special Permit as per City of Miami's Off -Street
Parking Guides and Standards to reduce parking stall width when adjacent to a
wall or column.
d) To apply for a Class II Special Permit as per City of Miami's Off -Street
Parking Guides and Standards to allow reduction of required backup distance
from 23'0" feet to 22'0
e) To apply for a Class II Special Permit to allow a reduction in size in
loading berths.
f) To apply for a Class II Special Permit of allow temporary structures,
occupancies, and uses necessary for construction including but not limited to a
construction trailers, security trailers, construction fence and covered walkway.
d) To apply for a Class II Special Permit to allow maneuvering on public
street (NE 2' Street) of loading trucks.
e) To apply for a Class II Special Permit to allow outdoor dining.
h) To apply for a Class I Permit for permanent recreation facilities.
i) To apply for a Class I Permit for staging and temporary off street parking
during construction.
j)
To apply for a Class I Permit to allow development/construction/rental and
sales signage.
k) To apply for a Class I Permit for a Federal Aviation Authority clearance
letter.
I) To apply for a Class I Permit to allow temporary events such as
groundbreaking ceremonies and the like.
m) To apply for a Class I Permit to allow for a sales/rental office.
o) To apply for Class I Permit to allow valet parking at the project.
To request a waiver from the City Commission as to the items listed below:
NOTE:
a) To request a waiver from the noise ordinance during the required
concrete pours for construction of the building.
b) To request an extension of the hours to facilitate concrete pours for
construction of the building.

To request and to apply for all lesser permits as may be required, to allow
development and construction of this project as contemplated under this
Major Use Special Permit Application as submitted and per plans on file
subject to and including any changes or modifications as may be required
as part of the Major Use Special Permit process to be included in a
Resolution Approving the project.
2) A Certificate of Appropriateness for ground disturbing activities has been
applied for and the conditions of same when issued included as part of
the Resolution Approving the project.

APPLICATION FOR MAJOR USE SPECIAL PERMIT suilnur TO COMPLIANCE,
WITH ZONING ORDINANCE 11000 and 'FLIE CITY CODE, AS AMENDED, AND TO
ALL APPLICABLE CRITERIA, CONSIDERATIONS AND/OR 0'111-1ER
REGULATIONS.
The proposed development "ONE BAYFRONT ,PLAZA" will be comprised of a Hotel
'rower of 850 rooms and an Office Tower with approximately 2,125,000 square feet of floor
area, both towers will have a common podium that .include approximately 1.12,0(1(.) square
feet of retail floor area at the first three levels, and 120,000 square feet of
exhibition/banquet floor area. The taller of the two structures (the Office Tower) will have
a maximum height of 1,037 feet 0 inches A.G.L. (1,049 feet 0 inches N.(.V,D.) at top of
parapet. The proposed project will provided a total of 2,563 off-street parking splices.
Three (3) parking spaces are in excess of the required 2,560 parking spaces for the project,
which may be utilized and maintained as valet parking
Pursuant to Zoning Ordinance 11000, as amended, Supplement 14, the Zoning Ordinance or
the City of Miami, Florida, the subject proposal for ONE BAYFRONT PLAZA, at 100 South
Biscayne Boulevard Miami, Florida, has been submitted and reviewed to allow an application
for Major Use Special Permit, subject to all applicable criteria;
MAJOR USE SPECIAL PERMIT, as per ARTICLE 17, Section 1701, Definition (2), to
allow non-residential uses involving in excess of two hundred thousand (200,000) square feet of
floor area;
MAJOR USE SPECIAL PERMIT, as per ARTICLE 17, Section 1701, Definition (3), to
allow a hotel involving in excess olthree hundred lilt)/ (350) rooms;
MAJOR USE SPECIAL PERMIT, as per ARTICLE 17. Section 1701, Definition (7), for
any single use or combination of uses requiring or proposing to provide in excess of live hundred
(500) off-street parking spaces;
The Major Use Special Permit encompasses the following Special Permits and requests:
CLASS II SPECIAL PERMIT, as per ARTICLE 4, Section 401, Class II Special Permits, to
allow erection of any new building in C131) district;
CLASS II SPECIAL PERMIT, as per ARTICLE 4, Section 401, Class II Special Permits, to
allow a waiver of the required live -foot setback on lots which have less than two hundred (200)
linear feet of frontage on a given street and where the location, size and native of adjacent
buildings would preclude future redevelopment with a consistent setback along al least one hall
(1/2)of the block;
CLASS II SPECIAL PERMIT, as per Article 1.5, Sect.1.512 Off -Street Parking Guides &
Standards, to allow reduction of required parking backup distance from 23%0" to 22%0".
CLASS II SPECIAL PERMIT, as per Article 15, Sect.I512, Section 1512, Class II Special
Permit required for waiver of design standard and guidelines to allow a waiver of City of Miami
Parking Guides & Standards requirement of one (I) additional foot in stall dimension where the side of
any stall abuts a wall, fence, building, or other physical obstruction, to allow the minimum stall
width dimension of 8'.-6" from face of any obstruction;
CLASS II SPECIAL PERMIT, as per ARTICLE 9, Section 923, Sub -Section 923.2, Sub -
Section 923.2.1. Reduction in stall dimensions by Class ll Special Permit criteria and
limitations on reductions, to allow reduction of eight (8) 12'x35'x15' loading berth dimensions
to eight (8) 10'x 25'x15' as follows;

CLASS II SPECIAL PERMIT, as per ARTICLE 9, Section 92'7. Temporary structures,
occupancies, and uses during construction, criteria for special permits, to al kw temporary

departments;
CLASS II SPECIAL PERMIT, as per ARTICLE 9, Section 917, Sub -Section 917.1.1,
Parking maneuvers on public streets or sidewalks prohibited; backing into an alley by
Class II Special Permit; exceptions, to allow maneuvering on public street (S.F. lm Street) of
three (3) loading trucks;
CLASS I SPECIAL PERMIT, as per ARTICLE 9, Section 906, Sub -Section 906.9.
'1'emporary special events; special permits; criteria, to allow temporary carnival, festival, lair
or similar type event on privately owned or City -owned land such as a ground breaking
ceremony;
CLASS I SPECIAL PERMIT, as per ARTICLE 9, Section 916, Sub-Seztion 916.2.1.
Temporary special event parking, to allow parking for temporary special event :tich as ground
breaking ceremonies;
CLASS 1 SPECIAL PERMIT, as per ARTICLE 9, Section 918, Sub -Section 918.2.
Temporary off-street offsite parking for construction crews, criteria, to allow 1ernporary off-
street offsite parking, for construction crews working on a residential project under construction,
within R-3 or more permissive zoning district;
CLASS I SPECIAL PERMIT, as per ARTICLE 9, Section 920, Sub -Section 920.1.2.
Limitations on occupancy of mobile homes, to allow parking of mobile homes, trailers or
manufactured homes, when authorized for security or other purposes in connection with land
development such as construction trailer(s) and other temporary construction offices such as
watchman's quarters, leasing and sales centers;
CLASS 1 SPECIAL PERMIT, as per ARTICLE 10, Section 10.5, Sub -Section 10.5.4.5,
CBD-Central Business District Commercial, Temporary Signs (3) , to allbw temporary
development signs;
REQUEST, for waiver of CHAPTER 36 NOISE, Section 36-6 Construction Equipment (a)
permitting the operation of construction equipment exceeding the sound level'of a reading
of 0.79 weighted average (IBA at any time and/or day subject to the City Manager Exception
pursuant to Section 36-6 (c) and all the applicable criteria;
.REQUEST .lor applicable MA,IOR USE SPECIAL., PERMIT, that the .following conditions be
required at the time of issuance of Shell Permit instead of at issuance of Foundation Permit:
l'he requirement to record in the Public Records a Declaration of Covenants and/or
Restrictions providing that the ownership, operation and maintenance of all common areas
and .facilities will be by the property owner and/or a mandatory property owner association;
.And the requirement to record in the Public Records a Unity of Title or a covenant in lieu of
a Unity oFfitle.
Note:
When more than one (1) special permit is required to address the same issue, the highest raking
permit granted shall be considered sufficient. Criteria from all applicable special permits kvill be
utilized in the review and approval of such permits.
