A RESOLUTION OF THE MIAMI CITY COMMISSION APPROVING THE
ESTABLISHMENT PURSUANT TO THE CONSULTANTS' COMPETITIVE
NEGOTIATION ACT ("CCNA") UNDER FLORIDA STATUTE SECTION 287.055
AND SECTION 18-87 OF THE CODE OF THE CITY OF MIAMI, AS AMENDED
(THE "CODE"), OF AN ONGOING COMPETITIVE SOLICITATION PROGRAM BY
THE DEPARTMENT OF CAPITAL IMPROVEMENTS AND TRANSPORTATION
("DEPARTMENT"), FOR THE PURPOSE OF ESTABLISHING A CONSTRUCTION
CONSULTANT PRE -QUALIFICATION PROGRAM (THE "PROGRAM"), FOR A
REVOLVING POOL OF QUALIFIED CONSULTANTS WITHIN THE
CONSTRUCTION RELATED DISCIPLINES OF ARCHITECTURE, ENGINEERING,
LANDSCAPE ARCHITECTURE, SURVEYING AND MAPPING SERVICES (THE
"PROGRAM PARTICIPANTS"); ESTABLISHING THAT THE DEPARTMENT WILL
PROVIDE FOR FUTURE CITY COMMISSION APPROVAL THE
TERMS,CONDITIONS AND FORM OF A MASTER AGREEMENT TO BE UTILIZED
TO MANAGE THE PROGRAM PARTICIPANTS; FURTHER AUTHORIZING THE
DEPARTMENT TO ADMINISTER THE PROGRAM AND THE CITY MANAGER
AND THE DEPARTMENT TO ISSUE THE ONGOING COMPETITIVE
SOLICITATION FOR SAID PROGRAM WITH FUNDING FOR SUCH PROGRAM
TO BE IN AMOUNTS NOT TO EXCEED FUNDS AVAILABLE AT THE TIME OF
NEED FROM THE BUDGETS OF VARIOUS CAPITAL PLAN PROJECTS AND
DEPARTMENTAL BUDGETS, SUBJECT TO BUDGETARY APPROVAL AND TO
COMPLIANCE WITH THE CCNA AND THE CODE.
WHEREAS, the Department of Capital Improvements and Transportation ("Department") has
determined that a pre -qualified list of consultants within the construction related disciplines of
architecture, engineering, landscape architecture, surveying, and mapping services is required to
expedite the delivery of construction work for various Citywide construction, maintenance and repair
projects ("Project" or "Projects"); and
WHEREAS, pursuant to the Consultants' Competitive Negotiation Act ("CCNA") under Florida
Statute Section 287.055 and Section 18-87 of the Code of the City of Miami, as amended (the
"Code"), the Department is requesting authorization by the City Commission to establish an ongoing
competitive solicitation program and related public notice procedures for the purpose of pre -qualifying
consultants and establishing a revolving pool of qualified service providers in the various construction
related disciplines of architecture, engineering, landscape architecture, surveying and mapping utilized
to design, manage and otherwise assist with the ongoing Citywide construction projects and
maintenance work (the "Consultant Pre -Qualification Program" or "Program"); and
WHEREAS, the Program will pre -qualify construction consultants in the construction related
disciplines of architecture, engineering, landscape architecture, surveying and mapping as applications
are submitted allowing on -going access to the program by qualified vendors at all times; and

WHEREAS, the Program will be advertised no less than quarterly in a local daily publication and
continuously on the Department's website; and
WHEREAS, the Program will be administered by the Department utilizing a Master Agreement the
terms, conditions and form of which will be presented in the future to the City Commission for approval
to be executed with each pre -qualified consultant selected to provide services (the "Program
Participants"); and
WHEREAS, this Resolution is requesting establishment of the Program, authorization for the
issuance of the solicitation and authorization for the Department to administer the Program and to
begin immediately pre -qualifying Program Participants; and
WHEREAS, funds for said Program are subject to budgetary approval at the time of need utilizing
funding from various Capital Plan projects and departmental budgets and subject to compliance with
the CCNA and the Code;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this section.
Section 2. The establishment pursuant to the CCNA under Florida Statute Section 287.055 and
Section 18-87 of the Code, of an ongoing competitive solicitation program by the Department, for the
purpose of establishing a Program, for a revolving pool of qualified consultants within the construction
related disciplines of architecture, engineering, landscape architecture, surveying and mapping
services (the "Program Participants"), is approved.
Section 3. The Department will provide for future City Commission approval the terms, conditions,
and form of a. master agreement to be utilized .to manage the Program Participants.
Section 4. The Department is authorized to administer and the City Manager and the Department
are authorized(1) to issue the ongoing competitive solicitation for said Program with funding for such
Program to be in amounts not to exceed funds available at the time of need from the budgets of
various capital plan projects and departmental budgets, subject to budgetary approval and to
compliance with the CCNA and the Code.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
