Fernandez, City Attorne DATE: June 4, 2007 RE: Proposed Settlement for City Commission Meeting - June 14, 2007 Caridad Farinas vs. City of Miami (File No. 07-00771) The attached proposed Resolution seeks authorization to pay $77,858.41 to Claimant's attorney, Barry Lerner, Esquire for attorney's fees and costs to settle all claims against the City of Miami, its officers, agents, and employees, in the above referenced case. The Claimant, Caridad Farinas, had various dates of accidents in the course and scope of her employment with the City of Miami, and filed claims for Workers' Compensation benefits against the City of Miami with the Division of Administrative Hearings, Office of the Judge of Compensation Claims, which claims have been resolved by agreement and/or adjudication. The Claimants' attorney is entitled to a reasonable attorney's fee for obtaining Workers' Compensation benefits secured pursuant to Chapter 440, Florida Statutes. The parties reached an agreement on compromised attorney's fees of $77,858.41, inclusive of costs. Settlement of this issue is recommended because $77,858.41is reasonable for this case. Funds, in the amount of $77,858.41, will be allocated from the Self -Insurance and Insurance Trust Fund, Index Code No. 05002.301001.524000.0000.00000 Attachment(s) cc: Pedro G.
