HomeMy WebLinkAboutR-07-0302City of Miami Legislation Resolution: R-07-0302 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00672 Final Action Date: 6/12/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION , WITH ATTACHMENT(S), CONFIRMING THE SALES PRICE LIMITS OF THE STATE HOUSING INITIATIVES PARTNERSHIP ("SHIP") PROGRAM FOR THE 2007-2010 LOCAL HOUSING ASSISTANCE PLAN ("LHAP") AS SUBMITTED TO THE FLORIDA HOUSING FINANCE CORPORATION, IN THE AMOUNT OF $236,800, FOR NEW CONSTRUCTION AND EXISTING CONSTRUCTION FOR THE FIRST-TIME HOMEBUYER PROGRAM, AND IN THE AMOUNT OF $300,000, FOR THE SINGLE FAMILY REHABILITATION, SINGLE FAMILY EMERGENCY AND SINGLE FAMILY REPLACEMENT HOMES PROGRAMS; FURTHER CONFIRMING THAT FIVE PERCENT (5%) OF THE SHIP ALLOCATION, PLUS FIVE PERCENT (5%) OF THE PROGRAM INCOME, IS INSUFFICIENT TO ADEQUATELY PAY THE NECESSARY COSTS OF ADMINISTERING THE LHAP; AUTHORIZING THE USE OF TEN PERCENT (10%) OF THE SHIP ALLOCATION, PLUS FIVE PERCENT (5%) OF THE PROGRAM INCOME, TO COVER THE NECESSARY COSTS OF ADMINISTERING THE LHAP/ADMINISTRATIVE EXPENSES ASSOCIATED WITH THE IMPLEMENTATION OF THE SHIP PROGRAM. WHEREAS, in July, 1992, the State of Florida enacted the William E. Sadowski Affordable Housing Act ("Sadowski Act") which provides for the allocation of a portion of new and existing documentary stamp taxes on deeds on real estate transactions to local governments for the development and maintenance of affordable housing; and WHEREAS, the Sadowski Act provided a dedicated revenue source for affordable housing and created the Florida State Housing Initiatives Partnership ("SHIP") Program; and WHEREAS, the Sadowski Act further requires local governments to establish an average area purchase price for new and existing housing benefiting from awards made pursuant to the Act; and WHEREAS, the methodology and purchase prices used are defined in the attached Local Housing Assistance Plan ("LHAP"); and WHEREAS, five percent (5%) of the local housing distribution plus five percent (5%) of program income is insufficient to adequately pay the necessary costs of administering the LHAP; and WHEREAS, the cost of administering the program may not exceed ten percent (10%) of the local housing distribution plus five percent (5%) of program income deposited into the trust fund, with certain statutory exceptions; and WHEREAS, it is the recommendation of the Administration that the City Commission approve the use of ten percent (10%) of the SHIP allocation, plus five percent (5%) of the program income, to cover the necessary costs of administering the LHAP/ administrative expenses associated with the implementation of the SHIP Program, as authorized by Florida Statutes Section 420.9075; and City of Miami Page 1 of 2 File Id: 07-00672 (Version: 1) Printed On: 3/30/2017 File Number: 07-00672 Enactment Number: R-07-0302 WHEREAS, the purchase price limits for the 2004-2007 LHAP is $236,800, for new and existing programs; and WHEREAS, pursuant to Resolution No. 07-0204, adopted April 12, 2007, the City Commission approved the City of Miami's ("City's") LHAP for the period of July 1, 2007 through June 30, 2010, for the City's continued participation in the SHIP Program; and WHEREAS, on April 12, 2007, the City Commission recommended to increase the purchase price limits for the Single Family Rehabilitation, Single Family Emergency and Single Family Replacement Homes Programs to $300,000; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The sales price limits of the SHIP Program for the 2007-2010 LHAP as submitted to the Florida Housing Finance Corporation, in the amount of $236,800, for new construction and existing construction for the First -Time Homebuyer Program, and in the amount of $300,000, for the Single Family Rehabilitation, Single Family Emergency and Single Family Replacement Homes Programs, are confirmed. Section 3. The Miami City Commission confirms that five percent (5%) of the SHIP allocation, plus five percent (5%) of the program income, is insufficient to adequately pay the necessary costs of administering the LHAP. Section 4. The use of ten percent (10%) of the SHIP allocation, plus five percent (5%) of the program income, to cover the necessary costs of administering the LHAP/ administrative expenses associated with the implementation of the SHIP Program, is authorized. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
