ZONINGC ANGE Approximately402 NE 36 Street & 347 NE 35 Terrace FILE NO: 06 0I.234zc pursuant to Article 4; Section 401 of Ordinance ..1.000, as ar Derided, the Zoning Ordinance of the City of Tvliaini, Florida, the subject proposal for an amendment to the Zoning Atlas has been reviewed as follows: The request is to change the Zoning designation as follows: The subject property consists of two lots fronting NE 36th Street, and NE 35t Terrace (a complete legal description on fie at the Hearing Boards Office), from R-4 "Multifamily High Density Residential" with SD-20 "Buffer Overlay" to C-1. "Restricted Commercial" with STJ-20s1 "Biscayne Boulevard Edgewater Overlay District". The following findings have been made: It is found that the character of NE 35th Terrace and to the East, and NE 36th Street is residential, specifically "High Density Multifamily Residential." It is found that the requested change will represent an intrusion of commercial uses into a high density residential neighborhood. it is found that a zoning change at this location may set a negative precedent and create a "domino effect" in regards to future zoning change applications. Based on these findings, the Planning Department is recommending denial of the application as presented.
