HomeMy WebLinkAboutR-07-0296City of Miami Legislation Resolution: R-07-0296 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00658a Final Action Date: 5/24/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY MANAGER TO REVISE CITY OF MIAMI ("CITY") POLICE DEPARTMENTAL ORDER 11.6.13.20: "ASSOCIATING WITH UNDESIRABLE PERSONS," REGARDING THE ASSOCIATION IN ANY MANNER WHATSOEVER, WITH CONVICTED FELONS, SO THAT IT DOES NOT INFRINGE UPON INTIMATE HUMAN RELATIONSHIPS AND THAT SUCH POLICIES AND GUIDELINES BE PREDICATED UPON THE FACT THAT SUCH ASSOCIATION MUST ENHANCE OR CONTRIBUTE TO CRIMINAL ACTIVITY; FURTHER DIRECTING THE CITY MANAGER TO WORK WITH THE FRATERNAL ORDER OF POLICE TO REFINE THE STANDARDS SO AS TO NOT INFRINGE UPON THE POLICE OFFICERS' CONSTITUTIONAL RIGHTS. BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA; Section 1. The City Manager is directed to revise City of Miami ("City") Police Departmental Order 11.6.13.20: "Associating with Undesirable Persons," regarding the association in any manner whatsoever, with convicted felons, so that it does not infringe upon intimate human relationships and that such policies and guidelines be predicated upon the fact that such association must enhance or contribute to criminal activity. Section 2. The City Manager is further directed to work with the Fraternal Order of Police to refine the standards so as to not infringe upon the police officers' constitutional rights. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
