Mr. Joseph H. Ganguzza offered the following resolution and moved its adoption
Resolution:
AFTER CONSIDERING THE FACTORS SET FORTH IN ZONING ORDINANCE NO.
11000, THE ZONING BOARD RECOMMENDED APPROVAL TO THE CITY
COMMISSION TO AMEND PAGE NO. 36, OF THE ZONING ATLAS OF ORDINANCE
NO. 11000, AS AMENDED, THE ZONING ORDINANCE OF THE CITY OF MIAMI,
ARTICLE 4, SECTION 401, SCHEDULE OF DISTRICT REGULATIONS, BY
CHANGING THE ZONING CLASSIFICATION FROM SD-4 WATERFRONT
INDUSTRIAL DISTRICT TO C-2 LIBERAL COMMERCIAL FOR THE PROPERTIES
LOCATED AT APPROXIMATELY 201 AND 243 NORTHWEST SOUTH RIVER DRIVE,
LEGALLY DESCRIBED AS EXHIBIT "A" (HEREBY ATTACHED), PUBLIC RECORDS
OF MIAMI-DADE COUNTY, FLORIDA.
Upon being seconded by Mr. Charles A. Garavaglia,
the motion was passed and adopted by the following vote:

Parcel A-1:
Commence at a Paint on the Southerly side of Miami River where the South line
of to 16 of Block 4 SOUTH, in the CITY OF MIAMi, according to the Plat thereof
recorded in Plat E' Page 41, of the Public Records of Bode County. Florida,
produced East intersects the low water line of the Miami River,- run thence
Southeasterly rneandecing, the taw water line of the River to the point where the
center line of Northwest Second Street (formerly Tenth Street) produced Fast
intersects the said law wafer line; thence West to the Ecst line of South River
Street; thence Northwesterly along the Northeasterly side of South River Street tc
e point directly West of the Point of Beginning; thence East to Point of Beginning;
also the submerged land lying between the tract of land described and the channel
of the Miami River.

Commence at a point of the Southerly side of Miami River where the South line of
Lot t of said Block 4 SQUTN, in the CITY OF MAMI, according to the PM thereof
recorded in Plot Sock B" Page 41, of the Public Records of Dade County, Florida
produced East intesects the law water line of Miami River, thence run
Southeasterly meandering the low water fine of the River to the point where the
South line of Lot 18 of said Block 4 South produced East intersects the said low
water line; thence West to the East line of South River Street; thence
Northwesterly along the Northeasterly side of South River Street to a point West
of Pain( of Beginning; thence East to Point of Beginning; also the submerged land
Virg between the tract of land last described and the channel of the Miami River.
Parcel E:
That parcel of land and submerged land bounded on the North by the Easterly
extension of the North line of Lot 2 in Block 4 SOUTH, CITY OF MIAMI, as recorded
in Plat Book B" at Page 41, of the Public Records of Miami —Dade County, Florida;
on the South by the Easterly extension of the South line of Lot 1 of the above
Block 4 50UT7-1; on the East by the Miami River;; on the West by the Easterly line
of N.W. South River Drive.

Circle appropriate condition):
When pertaining to the rezoning of and under application made under Article 22, the report and
recommendation of the Zoning Boafd shall show that the Zoning Board has studied and considered,
where applicable, whether or not:
a) The proposed change conforms with the adopted Miami Comprehensive Neighborhood Plan and
does not require a plan amendment.
b) The proposed change is in harmony with the established land use pattern.
c) The proposed change is related to adjacent and nearby district.
d) The change suggested is not out of scale with the needs of the neighborhood or the city.
e) The proposed change maintains the same or similar population density pattern and thereby does not
increase or overtax the load on public facilities such as schools, utilizes, streets, etc.
f) Existing district boundaries are illogically drawn in relation to existing conditions on the property
proposed for change.
g) Changed or changing conditions make the passage of the proposed change necessary.
h) The proposed change positively influences living conditions in the neighborhood.
i) The proposed change has the same or similar impact on traffic and does not affect public safety to a
greater extent than the existing classification.
j) The proposed change has the same or similar impact on drainage as the existing classification.
k) The proposed change has the same or similar impact on light and air to adjacent areas as the
existing classification.
I) The proposed change has the same or similar impact on property values in the adjacent area as the
existing c(assification.
m) The proposed change will contribute to the improvement or development of adjacent property in
accord with existing regulations.
n) The proposed change conveys the same treatment to the individual owner as to owners within the
same classification and the immediate area and furthers the protection of the public welfare.
o) There are substantial reasons why the use of the property is unfairly limited under existing zoning.
p) It is difficult to find other adequate sites in the surrounding are for the proposed use in districts
already permitting such use.
