A RESOLUTION OF THE MIAMI CITY COMMISSION DIRECTING THE CITY
ATTORNEY TO PREPARE AN AMENDMENT TO THE CHARTER OF THE CITY OF
MIAMI FOR CONSIDERATION AT AN ELECTION TO BE HELD ON NOVEMBER 6,
2007, PROPOSING UPON THE APPROVAL OF THE ELECTORATE, THE
INCLUSION OF A CITIZENS' BILL OF RIGHTS IN THE CHARTER.
WHEREAS, the Miami -Dade County Charter, contains a Citizen's Bill of Rights that seeks to
secure for all citizens of all municipalities located within Miami -Dade County ("County") the benefits of
a government that is held accountable to the residents and wherein all persons are treated fairly and
equitably; and
WHEREAS, the Miami City Commission hereby determines that the citizens of the City of Miami
("City") are entitled to have the rights as are guaranteed by the County Charter guaranteed by the
City Charter as well; and
WHEREAS, the Miami City Commission hereby determines that in addition to the rights
guaranteed under the County Bill of Rights, no citizen of the City should be deprived of any rights and
privileges conferred by law because of race, color, national origin, religion, gender, sexual orientation,
disability, marital status, familial status, or age;
NOW, THEREFOR, BE IT RESOLVED, BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The City Attorney is directed to prepare and bring back to the City Commission, in
accordance with the requirements set forth in Section 2-112 of the Code of the City of Miami, Florida,
as amended, an amendment to the City Charter for consideration at an election to be held on
November 6, 2007, proposing upon the approval of the electorate, the inclusion of a Citizens' Bill of
Rights in the City Charter that will contain all the rights guaranteed by the County's Citizens' Bill of
Rights and in addition thereto will also guarantee that no citizen of the City is to be deprived of any
rights and privileges conferred by law because of race, color, national origin, religion, gender, sexual
orientation, disability, marital status, familial status, or age.
Section 2. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{1}

Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall
become effective immediately upon override of the veto by the City Commission.
