HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00566 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A LOCAL AGENCY PROGRAM AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR THE EAST LITTLE HAVANA GREENWAY PROJECT, B-40686 (SEGMENT D), ALLOWING THE UTILIZATION OF A CONTRIBUTION OF FUNDS, IN THE AMOUNT OF $1,000,000, FROM THE STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, FOR SAID PROJECT, PREVIOUSLY ACCEPTED AND APPROPRIATED INTO CAPITAL IMPROVEMENT PROJECT NO. 341211, ENTITLED "GREENWAYS IMPROVEMENTS," PURSUANT TO ORDINANCE NO. 12693, ADOPTED JUNE 9, 2005. WHEREAS, the Florida Department of Transportation ("FDOT") with the approval of the Metropolitan Planning Organization, awarded federal grants to the City of Miami ("City"), in the amount of $2,000,000, for the construction of the Miami Riverwalk Extension: including $1,000,000, for the East Little Havana Greenway Project, B-40686 (Segment D) ("Project"); and WHEREAS, the City's contribution to the Project is a total not to exceed amount of $4,088,500; and WHEREAS, the Project will provide outdoor recreational opportunities and an alternative transportation corridor for people living and working along the river to easily and safely walk or bike to mass transit connectors; and WHEREAS, the proposed riverwalk extension for the Project, will run along South River Drive from approximately Northwest 1st Street to Northwest 4th Street, Miami, Florida; and WHEREAS, said grants were awarded with the support of the Miami River Commission and are consistent with the Miami River Greenways Action Plan, adopted in principle by the City in May, 2001; and WHEREAS, said grant funds were accepted and appropriated into Capital Improvement Project ("CIP") No. 341211, entitled "Greenways Improvements," pursuant to Ordinance No. 12693, adopted June 9, 2005; and WHEREAS, the attached Local Agency Program Agreement ("LAP") for the Project provides the terms and conditions for the City's use of the funds for the Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings found in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. The City Manager is authorized {1} to execute a LAP for the Project, in substantially the attached form, allowing the utilization of a contribution of funds, in the amount of $1,000,000, from FDOT, for said Project, previously accepted and appropriated into CIP No. 341211, entitled "Greenways Improvements," pursuant to Ordinance No. 12693, adopted June 9, 2005. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: QRGE L. FERNANDEZ i �` ` i-ciITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
