A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
GRANTING TO PALMETTO HOMES OF MIAMI, INC. ("PALMETTO HOMES"), AN
EXTENSION OF TIME UNTIL DECEMBER 31, 2007, IN WHICH TO: (1) COMPLETE
CONSTRUCTION OF, AND SELL, THE HOME LOCATED AT 5812 NORTHWEST 15
AVENUE, MIAMI, FLORIDA , AND (2) COMMENCE CONSTRUCTION ON THE
PROPERTIES LOCATED AT 1468 NORTHWEST 61 STREET AND 1466
NORTHWEST 61 STREET, MIAMI, FLORIDA; STATING THE INTENTION OF THE
CITY COMMISSION RELATED TO THE CONVEYANCE OF TITLE TO THE
PROPERTIES LISTED ON EXHIBIT "A," ATTACHED AND INCORPORATED;
AUTHORIZING THE CITY MANAGER TO EXECUTE MODIFICATIONS TO THE
DEEDS THAT CONVEYED THE PROPERTIES FROM THE CITY OF MIAMI TO
PALMETTO HOMES, AND ALL NECESSARY OTHER DOCUMENTS, FOR SAID
PURPOSE.
WHEREAS, pursuant to Resolution No. 04-0358, adopted May 27, 2004, the City of Miami ("City")
Commission approved the conveyance, with title reverter provisions, of six (6) vacant parcels located
in the Model City Homeownership Zone to Palmetto Homes of Miami, Inc. ("Palmetto Homes") for the
development of eight (8) single family homes; and
WHEREAS, pursuant to Resolution No. 05-0357, adopted May 26, 2005, the City Commission
approved the conveyance, with title reverter provisions, of eleven parcels of City owned land directly
to developers for the construction of affordable housing, with five (5) of the eleven parcels to be
conveyed to Palmetto Homes for the new construction of affordable single family homes; and
WHEREAS, due to delays in obtaining permits from the Department of Water and Sewer and the
Department of Environmental Resource Management, construction on the following property
conveyed to Palmetto Homes pursuant to Resolution No. 04-0358 has not been completed as
required by the Quit Claim Deed from the City, dated June 22, 2005: 5812 Northwest 15 Avenue,
Miami, Florida; and
WHEREAS, due to delays in obtaining permits from the Department of Water and Sewer and the
Department of Environmental Resource Management, construction on the following two (2) properties
conveyed to Palmetto Homes pursuant to Resolution No. 05-0357 has not commenced as required
by the Corrective Quit Claim Deeds from the City, dated as of September 30, 2005 and November 15,
2005: 1468 Northwest 61 Street and 1466 Northwest 61 Street, Miami, Florida; and
WHEREAS, the Administration recommends granting to Palmetto Homes an extension until
December 31, 2007, to: (1) complete construction of, and sell, the home located at 5812 Northwest
15 Avenue, Miami, Florida, and (2) commence construction on the properties located at 1468
Northwest 61 Street and 1466 Northwest 61 Street, Miami, Florida;

NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. An extension of time, until December 31, 2007, for Palmetto Homes of Miami, Inc.
("Palmetto Homes") to: (1) complete construction of, and sell, the home located at 5812 Northwest
15 Avenue, Miami, Florida, and (2) commence construction on the properties located at 1468
Northwest 61 Street and 1466 Northwest 61 Street, Miami, Florida, is approved.
Section 3. It is in the intention of the City Commission that title to the parcels described above
and in Exhibit "A," attached and incorporated, shall be deemed to have remained in Palmetto Homes
from the date of conveyance, and that the extension of time granted herein to commence and/or
complete construction shall be deemed to have been made as follows: on or before September 30,
2006, with regard to the property located at 1466 Northwest 61 Street, Miami, Florida; on or before
November 15, 2006, with regard to the property located at 1468 Northwest 61 Street, Miami, Florida;
and, on or before March 1, 2007, with regard to the property located at 5812 Northwest 15 Avenue,
Miami, Florida.
Section 4. The City Manager is authorized {1} to execute any required modifications to the deeds
that conveyed the properties from the City to Palmetto Homes, and all necessary other documents,
for said purpose.
Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
