A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING
AN INCREASE IN THE AGREEMENT DATED DECEMBER 8, 2006, WITH MIGUEL LOPEZ, JR.,
INC., FOR ADDITIONAL SERVICES REQUIRED FOR NECESSARY ASPHALT REPAIRS, FOR
THE PROJECT ENTITLED "ORANGE BOWL PARKING LOT REPAIRS (ADA)," PROJECT B-30521
("PROJECT"), IN AN AMOUNT NOT TO EXCEED $ 16,642.50, INCREASING THE TOTAL
AMOUNT FROM AN AMOUNT NOT TO EXCEED $96,146 TO A TOTAL AMOUNT NOT TO
EXCEED $112,788.50; ALLOCATING FUNDS FOR SAID INCREASE FROM CAPITAL
IMPROVEMENTS PROJECT B-30521; AUTHORIZING THE CITY MANAGER TO EXECUTE
AMENDMENT NO. I TO THE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, FOR
SAID PURPOSE,
WHEREAS, the City of Miami's ("City's") 2006 Settlement with the Department of Justice regarding accessibility for
individuals with disabilities at City -owned facilities ("Settlement") requires the City to repair the asphalt and re -stripe two of
the Orange Bowl parking lots; and
WHEREAS, on September 22, 2006, in order to comply with the Settlement, the Department of Capital Improvements and
Transportation issued Invitation for Bids No. 05-06-117 for the provision of asphalt repair and re -striping services
("Services") for the "Orange Bowl Parking Lot Repairs (ADA)," Project B-30521("Project"), conducted in compliance with
the Code of the City of Miami, Florida, as amended; and
WHEREAS, Miguel Lopez Jr., Inc. ("Contractor"), the lowest responsive and responsible bidder, was selected to
provide the Services for the Project; and
WHEREAS, the City and Miguel Lopez Jr., Inc. ("Contractor") entered into an Agreement on December 8, 2006; and
WHEREAS, the Contractor and the City identified an additional 3,170 square feet of asphalt, at 32 different locations
within the parking lots that are uneven and do not meet the slope criteria mandated by the Americans with Disabilities Act
("ADA") and the Settlement; and
WHEREAS, these additional areas were not identified in the design documents utilized during the bid process and were
not included in the original scope of work and now it is necessary to add these areas to the Contractor's scope of work; and
WHEREAS, the negotiated fee associated with the additional work is an amount not to exceed $16,642.50; and
