Purpose of Item: A Resolution of the City of Miami Commission, with attachment(s), authorizing the City Manager to execute an Amendment to Memorandum of Agreement (the "Amendment"); in substantially the attached form, with the State of Florida Department of Transportation ("FDOT"), for the use of i"DOT property in the vicinity of SW 4th Street, Miami, Florida under an elevated section of 1-95. amending the original Memorandum of Agreement ("Agreement") dated November 6, 1980, as amended, to provide for "lessing out" approximately 4,113 square feet from the original lease areas which have been subsequently deeded by FDOT to the City and amending Section 11 of the Agreement related to the insurance requirements and with all terms and conditions as more particularly set forth in said Amendment. Background Information: The City of Miami ("City") entered into a Memorandum of Agreement ("Agreement") on November 6, 1980, as amended, with the State of Florida Department of Transportation (FDOT) to allow the City to lease certain FDOT right-of-way property located in the vicinity of SW 4" Street under 1-95 for ninety-nine (99) years until 2079 for use as a City park (also known as Jose Marti Park). On September 12, 2006, the City accepted FDOT's conveyance of a certain portion of said property totalling approximately 4,113 square feet at no charge subject to a public purpose deed reverter to enable the City to further develop and enhance Jose Marti Park. The City and FDOT have now agreed to amend the original Agreement to account for the lessing out of 4113 square feet deeded by FDOT to the City from the original lease areas described in the original Agreement, as well as updating the insurance coverage amounts and insurance requirements for contractors and. subcontractors performing work on the property.
