A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH •ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO ACCEPT FROM THE STATE OF
FLORIDA, DEPARTMENTOF TRANSPORTATION ("FDOT"), THE FOLLOWING
THREE PARCELS OF LAND: PARCEL 1 CONTAINING APPROXIMATELY2,862
SQUARE FEET, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A,"
ATTACHED AND INCORPORATED; PARCEL 2 CONTAINING APPROXIMATELY
992 SQUARE FEET, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT' B,"
ATTACHED AND INCORPORATED; AND PARCEL 3 CONTAINING
APPROXIMATELY 259 SQUARE FEET, AS MORE 'PAJRTICULARLY bii 'SCR18ED
IN EXHIBIT "C," ATTACHED AND INCORPORATED,•OF'FDOT PROPERTY
LOCATED IN THE AREA OF SOUTHWEST 5TH 'STREET AND 3RD AVENUE,
MIAMI, FLORIDA , BY QUITCLAIM DEED, WITH A PUBLIC PURPOSE
REVERTER PROVISION, IN SUBSTANTIALLY THE ATTACHED FORA, TO BE
USED IN CONNECTION WITH THE DEVELOPMENT OF JOSE MARTI PARK;
FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE ALL
DOCUMENTS WHICH ARE NECESSARY TO EFFECTUATE SAID ACQUISITION.
WHERIAS,•there are three parcels of land, as described in Exhibits "A," "8" and "C," attached and
incorporated (collectively -the "Properties"); and
WHEREAS, said Properties are no longer required forstate highway purposes by the State of
Florida Department of Transportation ("FOOT"); and
WHEREAS, the City of Miami ("City") needs, and has requested FOOT to convey.the Properties;
and
WHEREAS, FOOT is willing to convey the Properties to the City at no charge but has requi ed a
public purpose reverter provision; and
WHEREAS, it is necessary that said Properties be accepted by the City in order to enable the
construction of the improvements for Jose Marti 'Park which willserve the best interestof the,generai
welfare of the City and Its inhabitants;
NOW, THEREFORE, BE IT RESOLVED 8Y THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section,
Section 2. The City Manager is authorized to accept the conveyance of the real Properties, in the
area of Southwest 5th Street and 3rd Avenue, Miami, Florida, as legally described in Exhibits "A," `8"
and "C," attached and incorporated, from FOOT, by Quitclaim Deed, with .a public purpose reverter

provision, in substantially the 'attached fora , to be used in connection with the development of dose
Marti Park.
Section 3. The City Manager is further authorized(1) to execute all documents which are

{1} The herein authorization is further subject to compliance with all requirements that may be
Imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2) if the Mayor does not sign this Resolution, it shall .become effective at the end of ten calendar days
from the date It was passed and adopted. If the Mayor•aetoes.this Resolution, i1 shall become
effective immediately upon override of the veto by the City Commission,
