WRIGHT III' Re: Appeal of Zoning Board Action; Legistar File No. 05-00076x; Item Z10 on November 13, 2006 Agenda Dear Ms. Fernandez: On behalf of Pinnacle Place LTD (the "Applicant") we hereby file this appeal of the Zoning Board's action on November 13, 2006 pursuant to Section 2001. of the City of Miami Zr,nin.g Ordinance No _1 1000. In support of the request for special exception, the Applicant set forth substantial, competent evidence, including hard data relating to parking needs of similar affordable housing developments and census -based analysis. Evidence against the request amounted to opinion testimony from neighbors and a planning recommendation devoid of any factual basis for its conclusion. Therefore, the Zoning Board's denial was arbitrary and capricious and not supported by competent substantial evidence. The appeal fees for this matter were collected by your department in the form of a surcharge at time of application. The application proposes a reduction of parking for an affordable housing development. The parking reduction will result in a development that is more compatible with the Ms. Tresita °ernandea November 17, 2006 Page 2 neighborhood and will result in significant cost savings on the construction of parking spaces that have gone unused in similar developments owned and operated by the Applicant's parent company, Pinnacle Housing. As Pinnacle Housing has a proven track record of building affordable housing, cost savings from this development will ensure continued development of affordable housing units in the City. Commencement of the development is contingent on the outcome of the application, therefore, please schedule the appeal hearing as soon as possible. Thank you for your attention to this matter.
