HomeMy WebLinkAboutR-07-0241City of Miami Legislation Resolution: R-07-0241 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00378A Final Action Date: 4/26/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION STRONGLY URGING CONTRACTORS TO DETERMINE THE BACKGROUND OF CONSTRUCTION WORKERS IN THEIR EMPLOY BY ENCOURAGING CONSTRUCTION WORKERS TO VOLUNTARILY SUBMIT TO CRIMINAL BACKGROUND SCREENING. WHEREAS, construction workers, by the very nature of their profession, have relatively liberal access to the residences that they have been contracted to improve; and WHEREAS, there appears to exist a correlation between increased construction activity in R-1 and R-2 residential zoning areas and the increase in reports of burglaries and other crimes in those districts; and WHEREAS, the City of Miami ("City") has a legitimate government interest in protecting the welfare and safety of its neighborhoods and neighborhood citizenry; and WHEREAS, existing Florida statutes allow municipalities to regulate any business, profession or occupation by requiring background screening; and WHEREAS, the City now seeks to regulate construction workers through the policy of voluntary criminal background screening; and WHEREAS, contractors would be responsible for implementing policies that encourage construction workers in their employ to voluntarily submit to criminal background screening; and WHEREAS, implementation of said policies would offer the protection to neighborhoods and neighborhood citizenry sought by the City; and WHEREAS, a contractor's decision not to implement a policy of voluntary background screening shall not be the basis for the City of Miami to deny a building permit; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this section. Section 2. The Miami City Commission strongly urges contractors to determine the background of construction workers in their employ by encouraging construction workers to voluntarily submit to criminal background screening. Section 3. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
