AN EMERGENCY ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING
CHAPTER 56/ARTICLE IV OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "TAXATION/HOMESTEAD EXEMPTION FOR SENIOR
CITIZENS," MORE PARTICULARLY BY AMENDING SECTION 56-86, TO CHANGE
THE HOMESTEAD EXEMPTION FROM $25,000 TO $50,000; CONTAINING A
REPEALER PROVISION, A SEVERABILITY CLAUSE, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the Legislature of the State of Florida has authorized municipalities to allow an
additional homestead exemption of up to $50,000 for any person who has the legal or equitable title
to real estate and maintains thereon permanent residence of the owner, who has attained age 65,
and whose household income does not exceed $20,000;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Ordinance are hereby
adopted by reference and incorporated as if fully set forth in this Section.
Section 2. Chapter 56/Article IV of the Code of the City of Miami, Florida, as amended, entitled
"Taxation/Homestead Exemption for Senior Citizens," is amended in the following particulars{1}
"Chapter 56
TAXATION
ARTICLE IV - HOMESTEAD EXEMPTION FOR SENIOR CITIZENS
Sec. 56-86. Qualification.
In accordance with Section 6(f), Article VII, of the Florida Constitution and F.S. § 196.075, as
may be amended from time to time, any person 65 years or over who has legal or equitable title to
real estate located within the city and maintains thereon his/her permanent residence, which
residence qualifies for and receives homestead exemption pursuant to Section 6(a), Article VII, of the
Florida Constitution, and whose household income does not exceed $20,000.00 shall be entitled to
make application for an additional homestead exemption of $25,000 $50,000. This additional home

stead exemption, if granted, shall be applicable to all ad valorem tax mileage rates levied by the city.

Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 4. This Ordinance is declared to be an emergency measure on the grounds of urgent
public need for the preservation of peace, health, safety, and property of the City of Miami, and upon
the further grounds of the necessity to make the required and necessary payments to its employees
and officers, payment of its debts, necessary and required purchases of goods and supplies, and to
generally carry on the functions and duties of municipal affairs.
Section 5. The requirement of reading this Ordinance on two separate days is dispensed with by
an affirmative vote of not less than four -fifths of the members of the Commission.
Section 6. This Ordinance shall become effective immediately upon its adoption and signature of
the Mayor.{1}

{2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten

effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
