HomeMy WebLinkAboutO-12907City of Miami Legislation Ordinance: 12907 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00263 Final Action Date: 4/12/2007 AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 40/ARTICLE III/SECTION 40-61, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "PERSONNEL/CIVIL SERVICE RULES AND REGULATIONS/DEFINITIONS," GIVING ELECTED OFFICIALS AUTHORITY TO DETERMINE THE SALARY AND TENURE OF THEIR RESPECTIVE STAFF AND REQUIRING COMMISSION APPROVAL OF ANY BONUS GIVEN TO SUCH STAFF BY ELECTED OFFICIALS UPON LEAVING OFFICE; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Chapter 40/ Article III/ Section 40-61, of the Code of the City of Miami, Florida, as amended, entitled "Personnel/Civil Service Rules and Regulations/Definitions," is further amended in the following particulars:{1} "CHAPTER 40 PERSONNEL ARTICLE III. CIVIL SERVICE RULES AND REGULATIONS Sec. 40-61. Definitions. For purposes of this article: Unclassified service comprises those positions specified in section 36 of the city Charter, which shall be interpreted in accordance with the following: (1) The city manager's "assistants and secretarial staff" shall include all members of the city manager's personal staff. Such positions also shall include assistants and secretarial staff positions authorized in the city budget for the mayor and each members of the city commission, provided that employees of such positions shall be nominated by the mayor or each commissioner, who shall determine the salary and tenure of such employees, subject to budgetary allocation by the City City of Miami Page 1 of 2 File Id: 07-00263 (Version: 2) Printed On: 3/23/2017 File Number: 07-00263 Enactment Number: 12907 Commission and provided that any benefits afforded to such employees by a commissioner or the mayor are consistent with benefits provided by the city generally to other city employees based on the employee's position and/or title, and which employees shall be appointed by the city manager. The mayor or a member of the city commission may authorize extra compensation for their assistants and secretarial staff positions including a lump -sum bonus payment to reward outstanding employees whose performance exceeds standards, provided that such bonus payment may not be included in an employee's regular base rate of pay and may not be carried forward in subsequent years. Upon leaving office the mayor or a member of the city commission is authorized to provide a one time lump -sum bonus payment to an employee provided that: (1) the employee's performance has exceeded standards; and (2) the payment does not exceed the elected official's current year budget appropriations for that item; and (3) the city commission approves such payment. The city manager shall place such one time lump -sum bonus payment request on the next available city commission agenda for consideration by the city commission. Section 2. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 3. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected. Section 4. This Ordinance shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} Words/and or figures stricken through shall be deleted. Underscored words and/or figures shall be added. The remaining provisions are now in effect and remain unchanged. Asterisks indicate omitted and unchanged material. {2} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become effective immediately upon override of the veto by the City Commission or upon the effective date stated herein, whichever is later.
