HomeMy WebLinkAboutR-07-0231City of Miami Legislation Resolution: R-07-0231 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00537 Final Action Date: 4/12/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION URGING GOVERNOR CHARLIE CRIST, THE MEMBERS OF THE FLORIDA LEGISLATURE, AND THE STATE OF FLORIDA DEPARTMENT OF CORRECTIONS, TO REFRAIN FROM THE PRACTICE OF PLACING SEX OFFENDERS WHO ARE ACTIVELY PAROLED AND ON PROBATION, TO LIVE UNDER THE JULIATUTTLE CAUSEWAY LOCATED IN THE CITY OF MIAMI, FLORIDA; DIRECTING THE CITY CLERK TO TRANSMIT A COPY OF THIS RESOLUTION TO THE OFFICIALS DESIGNATED HEREIN. WHEREAS, it has been widely reported that the State of Florida ("State") has been sanctioning and allowing registered sex offenders to live under bridges located within the City of Miami ("City") because the registered sex offender is precluded from living in other areas of the City by operation of "Lauren's Law" codified as Section 37-7 of the Code of the City of Miami, Florida, as amended; and WHEREAS, it appears that the State is aware that it is placing sexual offender parolees under the bridge of the Julia Tuttle Causeway (Interstate 1-95) in the City, who have a condition of parole that they wear an ankle bracelet while knowing that the parolee cannot fulfill that condition because they have no way of recharging the battery to that bracelet; and WHEREAS, the State's ability to properly supervise the parolee whose ankle bracelet is inactive due to a dead battery is severely diminished and threatens the health, safety and welfare of the citizens of Miami; NOW THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The Miami City Commission urges Governor Charlie Crist, the members of the Florida Legislature, and the State Department of Corrections to refrain from the practice of placing or allowing sex offenders under the bridge of the Julia Tuttle Causeway (Interstate 195) in the City of Miami, Florida. Section 3. The City Clerk is directed to transmit a copy of this Resolution to Governor Charlie Crist, the members of the Florida Legislature, and to James R. McDonough, Secretary of the State of Florida Department of Corrections. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
