A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO EXECUTE AN INTERLOCAL
AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, WITH MIAMI-DADE
COUNTY ("COUNTY"), FOR THE REIMBURSEMENT OF FEMA FUNDED
STORMWATER DRAINAGE PROJECTS, SPECIFICALLY FOR THE
COMPLETION OF THE DREDGING OF THE COMFORT CANAL, WITH SAID
AGREEMENT ESTABLISHING A REIMBURSEMENT PLAN FOR THE LOCAL
MATCH WHICH THE COUNTY SPENT ON THE CITY OF MIAMI'S BEHALF WITH
THE CITY'S COST SHARE OF NINETY-TWO PERCENT (92%) 1S $431,742,
WITH A TWO PERCENT (2%) MANAGEMENT FEE BASED ON THE CITY'S
SHARE OF THE CURRENT ESTIMATED COST IS $69,079, THE TOTAL
AMOUNT TO BE PAID TO THE COUNTY IS $500,821, PLUS INTEREST
(INTEREST RATE EQUIVALENT TO THE ANNUAL AVERAGE, BASED ON
MONTHLY TOTALS SET BY THE COUNTY FINANCE DEPARTMENT; SAID
AMOUNT IS TO BE PAID IN TWO INSTALLMENTS WITH THE FIRST PAYMENT
BEING RELEASED ON OR BEFORE SEPTEMBER 30, 2007 AND THE SECOND
AND FINAL PAYMENT BEING RELEASED ON OR BEFORE SEPTEMBER 30,
2008; ALLOCATING FUNDS FROM CAPITAL IMPROVEMENTS, PROJECTS
B-30534.
WHEREAS, on December 4, 2004, the Department of Environmental Resources Management
("DERM") transmitted a draft Interlocal Agreement ("Agreement") between Miami -Dade County
("County") and the City of Miami ("City") for the Federal Emergency Management Agency ("FEMA")
funded project on the Comfort Canal; and
WHEREAS, the Comfort Canal services the C-5 Drainage Basin area by lowering the watertable
which allows for a greater aquifer drainage and storage interaction during rainfall events and
minimizes the possibility of localized street flooding even in areas serviced by exfiltration systems (no
direct discharge areas), hence, improved conveyance of the Comfort Canal due to the recent FEMA
funded project benefited the entire basin area depicted on the attached map as Attachment "A" of the
Agreement; and
WHEREAS, said project was completed in 2005, after which DERM provided a final cost update to
the City on December 12, 2005, and the County is requesting that the City enter and complete the
Agreement so that they can recoup the funds which it has already spent on the City's behalf, under the
Local Share of named project; and
WHEREAS, the Agreement establishes a reimbursement plan for the local match which the
County spent on the City's behalf; and
WHEREAS, the City's Cost Share of ninety-two percent (92%) is $431,742, with a two percent
(2%) Management Fee based on the City's share of the Current Estimated Cost and is $69,079, with

the grand total to be paid to the County is $500,821, plus interest (interest rate equivalent to the
annual average, based on monthly totals set by the County Finance Department); and
WHEREAS, this amount is to be paid in two installments with the first payment being released on
or before September 30, 2007 and the second and final payment being released on or before
September 30, 2008; and
WHEREAS, funds are being allocated from Capital Improvements, Project B-30534; and
WHEREAS, the City Manager is authorized to execute the Agreement, in substantially the attached
form; and
WHEREAS, the City Manager is authorized to reimburse the County for $500,821, plus interest for
the City's Local Match;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to execute an Agreement, in substantially the
attached form, with the County, for the reimbursement of FEMA funded stormwater drainage projects,
specifically for the completion of the dredging of the Comfort Canal, with said Agreement establishing
a reimbursement plan for the local match which the County spent on the City's behalf with the City's
cost share of ninety-two percent (92%) is $431,742, with a two percent (2%) management fee based
on the City's share of the current estimated cost is $69,079, the total amount to be paid to the County
is $500,821, plus interest (interest rate equivalent to the annual average, based on monthly totals set
by the County Finance Department; said amount is to be paid in two installments with the first payment
being released on or before September 30, 2007 and the second and final payment being released on
or before September 30, 2008, with funds allocated from Capital Improvements, Projects b-30534.
Section 3. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}

{1} The herein authorization is further subject to compliance with all requirements that may be imposed
by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code
provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days
from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
