A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING
THE CITY MANAGER TO EXECUTE THE SECOND AMENDMENT, IN SUBSTANTIALLY THE
ATTACHED FORM, TO THE OPERATING AGREEMENT FOR WATSON ISLAND PARKING
OPERATIONS BETWEEN THE CITY OF MIAMI ("CITY") AND THE DEPARTMENT OF
OFF-STREET PARKING ("DOSP"), DATED SEPTEMBER 9, 2003, TO PROVIDE DOSP'S USE OF
ADDITIONAL GRANT FUNDS, IN AN AMOUNT NOT TO EXCEED $200,000, RECEIVED BY
THE CITY FROM THE FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION, AND
FUNDS, IN AN AMOUNT NOT TO EXCEED $50,000, FROM CAPITAL IMPROVEMENTS
PROJECT NO. 311047, FOR DESIGN AND CONSTRUCTION OF THE BOAT RAMP PARKING
AND ANCILLARY FACILITIES (COLLECTIVELY "PARKING FACILITIES") TO BE LOCATED
ON WATSON ISLAND, MIAMI, FLORIDA, SUBJECT TO DOSP'S COMPLIANCE WITH THE
TERMS AND CONDITIONS RELATED TO THE USE OF THE FUNDS AS SET FORTH IN THE
AMENDED AGREEMENT.
WHEREAS, the City of Miami ("City") is the owner of certain real property and improvements located on Watson
Island, Miami, Florida; and
WHEREAS, on August 8, 2002, the City and the Department of Off -Street Parking ("DOSP") executed an agreement for
DOSP to design, construct, finance, operate, maintain and manage two parking facilities on Watson Island; and
WHEREAS, one parking facility will be located in the boat ramp area which will include a baywalk and public restroom
facility, and the other will be located on the south side of the island, and will accommodate the parking for the Miami
Children's Museum, Aviation and Visitors' Center and overflow parking for Parrot Jungle Island (collectively the "Parking
Facilities"); and
WHEREAS, on September 9, 2003, the City entered into an Amended and Restated Operating Agreement
("Agreement"), which provided for DOSP's use of Florida Inland Navigation District ("FIND") grant funds, in the amount of
$150,000, received by the City for the design and construction of' the Parking Facilities; and
WHEREAS, the City wants to make available for DOSP's use of additional grant funds in an amount not to exceed
$200,000, received from Florida Department of Environmental Protection ("FDEP"), Land and Water Conservation Fund
• Program and an additional amount not to exceed $50,000 from Capital Improvements Project No. 311047, for design and
construction of the Parking Facilities;
