CASE NO. 06-01239x Pursuant to Article 4, Section 401 (Schedule of District Regulations, Permitted Principal Use under the C-1 "Restricted Commercial" of Ordinance 11000, as amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has been reviewed to permit a Supper club use at the subject property as :follows: The following findings have been made: • It is found that requested Supper Club use for this property was previously approved, with one condition, April 26, 2004 by Zoning Board (Case No. 2004-0785). However, the condition specifically stipulated that it was for that particular owner/operator and in the event, that it changed owner/operator; a separate Special Exception would be needed. • It is found that the subject property consists of an existing one-story structure; it is also found that the proposed use is a continuation of what was previously approved which is an appropriate adaptive reuse of the existing structure. • It is found that the proposed use is appropriate for this location within the SD-8 "Design Plaza Commercial -Residential" district due to its proximity to design - oriented service uses and meaningful ground level pedestrian activity which will benefit the area by having a night club use nearby. • It is found that the applicant has a valid certificate of use for restaurant, Lounge which complies with the criteria set forth in Section 1305 of Zoning Ordinance 11000. • It is found that upon compliance with the condition set forth below, this project will not have any adverse impacts on the surrounding area. Based on these findings, the Planning Department is recommending approval of the application with the following condition: 1. Approval of this special exception shall run with this operator only; any changes to a different operator shall require a separate Special Exception.
