HomeMy WebLinkAboutR-07-0165City of Miami Legislation Resolution: R-07-0165 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00344 Final Action Date: 3/22/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION RESCINDING RESOLUTION NO. 76-919, ADOPTED OCTOBER 14, 1976, IN ITS ENTIRETY, REGARDING THE GRANT APPLICATION PROCESS ; AUTHORIZING THE CITY MANAGER OR HIS DESIGNEE TO SUBMIT APPLICATIONS FOR ALL TYPES OF GRANTS, WITHOUT FIRST SUBMITTING SAID APPLICATIONS TO THE CITY COMMISSION FOR PRE -APPROVAL; FURTHER REQUIRING THE CITY MANAGER TO SUBMIT TO THE CITY COMMISSION FOR FINAL APPROVAL ANY GRANT AWARD AND ANY GRANT AGREEMENT OVER THE AMOUNT OF $25,000, IN ORDER TO IMPLEMENT SAID GRANT. WHEREAS, pursuant to Resolution No. 76-919, adopted October 14, 1976, the City Commission authorized the City Manager to submit without prior City Commission approval grant applications only in connection with Federal and State grants; and WHEREAS, since that time the City of Miami ("City") has become eligible for a wide variety of grants including, but not limited to grants from Federal, State, local, foundation, corporate and not -for -profit entities; and WHEREAS, since 1976, the City now has an Office and Director of Grants Administration; and WHEREAS, the City Manager has determined that it is in the best interest of the City to authorize the Director of the Office of Grants Administration to serve as the designee of the City Manager for submission of all grants applications; and WHEREAS, it is also in the best interest of the City that once a grant application over the amount of twenty-five thousand dollars ($25,000) is awarded to the City, the City Manager is to return to the City Commission for acceptance and creation of any special revenue funds and to authorize details specific to each grant award and agreement; and WHEREAS, this Resolution does not change any previously established procedures or requirements for execution and acceptance of any grant applications; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Resolution No. 76-919, adopted October 14, 1976, regarding the grant application process, is rescinded in its entirety. Section 3. The City Manager or his designee is authorized{1} to submit applications for all types City of Miami Page 1 of 2 File Id: 07-00344 (Version: 1) Printed On: 3/21/2017 File Number: 07-00344 Enactment Number: R-07-0165 of grants, without first submitting said applications to the City Commission for pre -approval. Section 4. The City Manager is further required to submit to the City Commission for final approval, any grant award and any grant agreement over the amount of $25,000, in order to implement said grant. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor{2}. Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
