HomeMy WebLinkAboutR-07-0146City of Miami Legislation Resolution: R-07-0146 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00267 Final Action Date: 3/8/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE A PUBLIC TRANSPORTATION JOINT PARTICIPATION AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, BETWEEN THE CITY OF MIAMI AND THE FLORIDA DEPARTMENT OF TRANSPORTATION, FOR THE CONSTRUCTION OF THE PUBLIC HELIPORT PROJECT ("HELIPORT PROJECT") ON WATSON ISLAND, IN THE AMOUNT OF ONE MILLION DOLLARS ($1,000,000); AUTHORIZING THE ALLOCATION OF REQUIRED MATCHING FUNDS FOR SAID HELIPORT PROJECT, IN AN AMOUNT NOT TO EXCEED ONE MILLION DOLLARS ($1,000,000), FROM FUNDS TO BE IDENTIFIED BY THE CITY MANAGER PRIOR TO THE EXPENDITURE OF SAID FUNDS. WHEREAS, the City of Miami ("City") is the owner of certain real property and improvements located at Watson Island, Miami, Florida; and WHEREAS, the Watson Island Aviation and Visitors Center (the "Aviation Facility") was established in the Capital Improvement Program, Project No. 344101, pursuant to Ordinance No. 11528, adopted July 24, 1997; and WHEREAS, pursuant to Resolution No 98-1120, adopted November 17, 1998, the City Commission authorized a Joint Participation Agreement (the "Original Agreement") between the City and the Florida Department of Transportation ("FDOT"), executed January 12, 1999, that provided funding assistance in the amount of $4,700,419, for the design and construction of the Watson Island Air Transportation Facilities Planning Program; and WHEREAS, pursuant to Resolution No. 05-458, adopted July 28, 2005, the City Commission authorized a Joint Participation Agreement No. 2 between the City and FDOT, executed September 9, 2005, that reduced funding assistance to $1,000,000 for the design and construction of the public heliport on Watson Island; and WHEREAS, due to the age of the Original Agreement executed on January 12, 1999, the original funding amount has expired and FDOT has established new funds which require a new Joint Participation Agreement ("JPA"); and WHEREAS, funds for the allocation of the City's required matching funds, in an amount not to exceed $1,000,000, for said Aviation Facility, which includes the public heliport project (the "Heliport Project"), will be identified by the City Manager prior to the expenditure of said funds; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 2. The City Manager is authorized{1} to execute a Public Transportation JPA, in substantially the attached form, between the City and FDOT, for the construction of the Heliport Project on Watson Island in the amount of one million dollars ($1,000,000). Section 3. The allocation of required matching funds for said Heliport Project, in an amount not to exceed one million dollars ($1,000,000), is authorized, from funds to be identified by the City Manager prior to the expenditure of said funds. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
