HomeMy WebLinkAboutR-07-0135City of Miami Legislation Resolution: R-07-0135 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00308 Final Action Date: 3/8/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), APPROVING THE SALE OF TWO CITY OF MIAMI ("CITY") OWNED PROPERTIES LOCATED AT 1632 NORTHWEST 59 STREET, MIAMI, FLORIDA, AND 1446 NORTHWEST 61 STREET, MIAMI, FLORIDA ,TO THE INDIVIDUALS SPECIFIED IN "EXHIBIT A," ATTACHED AND INCORPORATED; AUTHORIZING THE CITY MANAGER TO EXECUTE A PURCHASE AND SALE AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND TO EXECUTE SUCH OTHER DOCUMENTS AS MAY BE NECESSARY TO CONSUMMATE SUCH TRANSACTION IN ACCORDANCE WITH THE TERMS AND CONDITIONS OF THE AGREEMENT, WHICH TERMS MAY BE AMENDED BY THE CITY MANAGER AS MAY BE NECESSARY IN ORDER TO MEET THE BEST INTERESTS OF THE CITY. WHEREAS, the Model City Community Revitalization District Trust ("Trust") was established by the City Commission on July 10, 2001, pursuant to Ordinance No. 12082, to revitalize the Liberty City Area; and WHEREAS, as part of the revitalization effort, the Trust purchased from private owners and/or properties were transferred to the Trust from the City of Miami's ("City's") vacant land inventory to be developed and sold to low income families in the Liberty City Area; and WHEREAS, on October 15, 2003, the property located at 1632 Northwest 59 Street, Miami, Florida, was purchased and rehabilitated; and WHEREAS, on February 14, 2005, the property located at 1446 Northwest 61 Street, Miami, Florida, was deeded from the City to the Trust for the construction of a new affordable home; and WHEREAS, on October 30, 2006, the Board of the Trust authorized the City Manager to execute a Quite Claim Deed for all properties owned by the Trust to the City; and WHEREAS, on January 24, 2007, the City Manger executed a Quit Claim Deed on behalf of the Model City Trust transferring the properties to the City; and WHEREAS, both Ms. Jacqueline Willis and Ms. Katonya Mincey, certified low income individuals, have expressed the desire to purchase the properties at 1632 Northwest 59 Street, Miami, Florida, for $165,000 and 1446 Northwest 61 Street, Miami, Florida, for $140,000, respectively; and WHEREAS, all proceeds of the sale will go to the Liberty City Trust fund; and WHEREAS, the properties must remain owner -occupied for a period of thirty (30) years; and WHEREAS, in the case of sale or transfer of the property, the borrower will be required to sell the home to an income eligible borrower approved by the City at a price not to exceed the maximum City of Miami Page 1 of 2 File Id: 07-00308 (Version: 1) Printed On: 3/20/2017 File Number: 07-00308 Enactment Number: R-07-0135 allowable purchase price approved by the City Commission in existence at the time of sale; and WHEREAS, the Administration recommends the sale of two City -owned properties located at 1632 Northwest 59 Street, Miami, Florida and 1446 Northwest 61 Street, Miami, Florida, to the individuals specified in "Exhibit A," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The sale of two City -owned properties located at 1632 Northwest 59 Street Miami, Florida and 1446 Northwest 61 Street; Miami, Florida, to the individuals specified in "Exhibit A," attached and incorporated, is approved. Section 3. The City Manager is authorized {1} to execute a Purchase and Sale Agreement ("Agreement"), in substantially the attached form, to consummate such transaction in accordance with the terms and conditions of the Agreement, and to execute such other documents that may be necessary to consummate such transaction in accordance with the terms and conditions of the Agreement, which terms may be amended by the City Manager as may be necessary in order to meet the best interests of the City. Section 4. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
