Initiating the Conflict Resolution Procedures Provided by Chapter
164, Florida Statutes, City of Miami v. Miami -Dade County
(File No. 07-00292)
The attached proposed Resolution seeks to have the City Commission initiate the conflict
resolution procedures, provided by Chapter 164, Florida Statutes, in order to resolve a claim
against Miami -Dade County arising from a motor vehicle accident.
On July 4, 2005, a Miami -Dade County solid waste truck collided with a City of Miami
solid waste truck at the County Central Transfer Station (1150 Northwest 20t1' Street). The
County truck had its front trash loader down, obscuring its vision, and it veered into the left lane
and struck the City truck head-on.
Pursuant to Gallagher Bassett, the City is seeking $32,496.40, in property damage to the
City truck, along with $20,472.10, paid -to -date in worker's compensation benefits.
The City must first comply with Chapter 164 before filing a complaint, in court, against
the County.
