File slumber: 05-00130 Final Action Date: 2/24/2005 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO EXECUTE THE FIRST AMENDMENT AND EXTENSION TO THE PROFESSIONAL SERVICES AGREEMENT ("AGREEMENT"), IN SUBSTANTIALLY THE ATTACHED FORM, WITH BROWN AND BROWN, INC., TO PROVIDE INSURANCE BROKERAGE SERVICES FOR THE 2005-2006 PERIOD, WITH THE OPTION TO EXTEND FOR AN ADDITIONAL ONE-YEAR PERIOD, PURSUANT TO REQUEST FOR LETTERS OF INTEREST NO, 02-03-032, SUBJECT TO THE TERMS, CONDITIONS AND PRICING OF THE ORIGINAL AGREEMENT, IN AN ANNUAL AMOUNT NOT TO EXCEED $110,000; ALLOCATING FUNDS IN AN ANNUAL AMOUNT NOT TO EXCEED $110,000, FROM ACCOUNT CODE NO. 515001.624401.6340.65019, FOR THE CURRENT FISCAL YEAR WITH FUTURE FISCAL YEAR FUNDING SUBJECT ONLY TO BUDGETARY APPROVAL. WHEREAS, the City of Miami issued Request for Letters of Interest No. 02-03-032 ("RFLI") for insurance brokerage services, which authorized the execution of a professional services agreement ("Agreement") with the successful broker for a one-year period with the option to extend for four additional one-year periods; and WHEREAS, pursuant to Resolution No. 03-515, adopted May 22, 2003, the City Commission approved the recommendation of Brown and Brown, Inc. and authorized the execution of an agreement for a one-year period for 2003-2004, with the option to extend for an additional one-year period for 2004-2005; and WHEREAS, the City has increased its coverage while realizing premium cost savings at a reasonable service fee, and the Department of Risk Management is seeking the continued services of Brown and Brown, Inc. as authorized by the RFLI, by amending and extending the existing contract, at the same cost, terms, and conditions for a one-year period for 2005-2006, with the option for an additional one-year period for 2006-2007; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. .Section 2. The City Manager is authorized{1} to execute the First Amendment and extension to the Agreement, in substantially the attached. form, with Brown and Brown, Inc., to provide insurance brokerage services for a one-year period for 2005-2006, with the option to extend for an additional one-year period for 2006-2007, pursuant to the RFLI, subject to the terms, conditions and pricing of said Agreement, in an annual amount not to exceed $1 10,000, with funds allocated in an annual amount not to exceed $110,000, from Account Code No. 515001.624401.6340.6, for the current Fiscal City of Miami Page 1 of 2 Printed On: 5/30/2006 File Number: 05-00130 Enactment Number: R-05-0123 Year with future Fiscal Year funding subject only to budgetary approval. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: (1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
