Pursuant to Zoning Ordinance 11000, as amended, Supplement 14, the Zoning Ordinance
of the City of Miami Florida, the subject proposal for Bird Road office Building at 3760
Bird Road, Miami, Florida, has been submitted and reviewed to allow an application for a
substantial amendment to the Major Use Special Permit and request a Variance for
relaxation of height, subject to all applicable criteria.
Variance for height Bird Road (Arterial Collector):
Street side setback:
Maximum height- 265'-10"
Proposed - 291'-10"
Request to waive - 26'-O"
Required - 7'-6"
Proposed - 3' 9"
Request to waive - 3'-9"
in determining the appropriateness of the Variances for the proposed office project
the following findings have been made:
• It is found that the proposed office building project will benefit this area by creating
new employment opportunities for residents of the area.
It is found that special conditions exist which are peculiar to the land. The lot has four
street frontages and therefore, in order to accommodate liner uses as well as parking
garage uses in a positive manner such street side set back waiver is needed.
• It is found that the reason for the Bird Road maximum height variance is because the
applicant has chosen to put most of the office program towards the south of the
property in order to allow for a better pedestrian experience that provides an open
plaza at ground level in front of the retail space along Bird Road_
• It is found that the applicant also has chosen to create office liners for the first nine
floors along Bird Road which completely hides the parking garage uses from public
view.

It is found that these variances are the minimum necessary to have reasonable use of
the land and the granting of these variances will be in harmony with the general intent
and purpose of the Zoning Ordinance and will not be injurious to the neighborhood.
Based on these findings, the Planning Department is recommending approval of the
requested variances as part of a Major Use,
