Re: 1001 Brickell Bay Tower (the "Project") - Request for Waiver of Rear and Side
Yard Setback Requirements, pursuant to Section 3(mm)(ii) of the Charter of the
City of Miami
Dear Teresita:
On behalf of Brickell Bay Tower Ltd., Inc., this letter is a request to the City
Commission for a waiver of the rear and side yard setback requirements of Sec. 3
(mm)(ii) of the Charter of the City of Miami. The Project proposes to provide a 20-foot
setback along the waterfront (rear) yard and side yards equal to eighteen (18) feet on
the North side and thirty-six (36) feet on the South side as shown in the attached plans
prepared by Fullerton Diaz Architects and dated November 1, 2006. Pursuant to
instructions from Lourdes Slazyk, Zoning Administrator, we are including a check for
$2,000 for the filing fee for this request. We are also submitting a Disclosure of
Ownership List and a list of property owners with labels for notification of such owners
within 500 feet of the Property.

Before me, the undersigned, this day personally appeared N. Patrick Range , who being by me
first deposes and says:
i. That he/she is the owner, or the legal representative of the owner, submitting the accompanying
application for a public hearing as required by the Code of the City of Miami, Florida, affecting the real
property located in the City of Miami, as described and listed on the foregoing pages of this affidavit
and made a part thereof.
2. That all owners which he/she represents, if any, have given his/her full and complete permission for
hirn/her to act in his/her behalf for the change or modification of a classification or regulation of zoning
as set out in the foregoing petition, 0 including or 0 not including responses to day to day staff
inquires.
