HomeMy WebLinkAboutR-07-0098City of Miami Legislation Resolution: R-07-0098 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 07-00148 Final Action Date: 2/22/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO ACCEPT GRANT FUNDING FROM THE FLORIDA DEPARTMENT OF STATE, DIVISION OF LIBRARY AND INFORMATION SERVICES, IN AN AMOUNT NOT TO EXCEED $500,000, FOR THE VIRRICK PARK COMMUNITY CENTER LIBRARY PROJECT, AS STATED HEREIN; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE THE GRANT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND ANY OTHER NECESSARY DOCUMENTS FOR THE ADMINISTRATION OF SAID GRANT. WHEREAS, the City of Miami ("City") added the design and construction of a 5,000 square foot public library in the West Coconut Grove area to the Capital Plan as requested by the Coconut Grove Homeowners Association, the Elizabeth Virrick Park Citizens Committee, the One Grove Alliance, the Cocoanut Grove Village Council and other local organizations and individual Coconut Grove residents; and WHEREAS, the Virrick Park Community Center Library Project ("Project") is located adjacent to Virrick Park's multi -purpose building and will complement after school and tutoring programs conducted by the Mayor's Mentoring Initiative, the Department of Parks and local not -for -profit organizations; and WHEREAS, the City is responsible for the design and construction of the structure which will then be furnished, equipped and operated as a public library by Miami -Dade County, pursuant to an Interlocal-Agreement; and WHEREAS, the Project required additional funding beyond the available City funds; and WHEREAS, Resolution No. 05-0176, adopted March 24, 2005, authorized the City Manager to apply for grant funding from the Florida Department of State, Division of Library and Information Services ("State"), for the Project in the amount of $500,000; and WHEREAS, the State awarded the City $500,000, for the Project; and WHEREAS, Homeland Defense/Neighborhood Improvement Bond funding for Capital Improvements Project No. B-30292 entitled "Virrick Park Community Center Library," in the amount of $1,000,000, was allocated for the Project as part of the Capital Plan pursuant to Resolution No. 06- 0335, adopted May 25, 2006; and WHEREAS, said funds will be utilized as the City's required match; and WHEREAS, the award must be formally accepted and appropriated by the City; and WHEREAS, this Resolution authorizes the City Manager to execute the necessary documents to City of Miami Page 1 of 2 File Id: 07-00148 (Version: 1) Printed On: 3/17/2017 File Number: 07-00148 Enactment Number: R-07-0098 accept and administer the grant; and WHEREAS, the grant funds will be appropriated by a separate Resolution; and WHEREAS, upon completion of the Project, the Miami -Dade County Public Library System will have sufficient funds available to operate the facility; and WHEREAS, the building will be used exclusively for the public library and related educational purposes for which constructed and any proposed changes in use will be submitted to the Division of Library and Information Services for approval if it is within 20 years of completion of the Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to accept grant funding from the State, in an amount not to exceed $500,000, for the Project. Section 3. Pursuant to Resolution No. 06-0335, adopted May 25, 2006, the City's required matching funds, in an amount not to exceed $500,000, were allocated from Capital Improvement Project No. B-30292, entitled "Virrick Park Community Center Library." Section 4. The City Manager is further authorized{1} to execute the Grant Agreement, in substantially the attached form, and any other necessary documents for the administration of said grant. Section 5. Said grant will be appropriated by a separate Resolution. Section 6. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
