This application is intended to serve as a guide in acquainting you with our public hearing process. By any means, please feel free to contact us at the number above, should you have any questions. City of Miami Ordinance No. 11469, codified in Chapter 2, Article VI of the City Code states that ANY PERSON WHO RECEIVES COMPENSATION, REMUNERATION OR EXPENSES FOR CONDUCTING LOBBYING ACTIVITIES TO REGISTER AS A LOBBYIST WITH THE CITY CLERK, PRIOR TO ENGAGING IN LOBBYING ACTIVITIES BEFORE CITY STAFF, BOARDS, COMMITTEES AND THE CITY COMMISSION. A COPY OF SAID ORDINANCE IS AVAILABLE IN THE OFFICE OF THE CITY CLERK (MIAMI CITY HALL), LOCATED AT 3500 PAN AMERICAN DRIVE, MIAMI, FLORIDA, 33133. Copies of lobbyist documentation with proof of payment must be submitted with the complete application. The deadline to file the complete application with supporting documents is the first five workingilaysMALgt each month from 8:00 am until 3:00 pm, The responses to this application must be typed and signed in black ink. Please note that pursuant to Section 1304.2.2 of the Miami Zoning Ordinance, no application shall be deemed to have been filed unless and until the applications shall have been completed. All pertinent and accurate information/documentation; i.e., the plans, reports, exhibits, shall be presented at the time of filing, in addition to the paid receipt. The applicant is responsible for the accuracy of the information contained in the application and all supporting materials. If you like, you could bring the materials to our office for staff review before the deadline to ensure the application is complete. Upon submittal, this application must be accompanied with a signed Zoning Referral. You will be responsible, if needed, to bring an interpreter for the English language to any presentation before city boards, committees and the city commission. A valid power of attorney will be required if neither applicant or legal counsel representing the applicant execute the application or desire to make a presentation before city boards, committees and the city commission. Applications for Zoning Change (Amendment to Zoning Atlas and/or Overlay District) and Land Use Change (Amend the Comprehensive Neighborhood Plan) will not be accepted unless it is signed or initialed and dated by the Planning Department designee. Present zoning designation(s): R-2 Statement as to why the present zoning designation is inappropriate. The present zoning designation is inappropriate because the medium -to -low density residential designation has already been compromised as the properties to the immediate north and east are used as parking for adjacent C-1 properties, including Parcel 2, the eastern 100 feet of which is currently zoned C-1, and the remainder of which is operating under a variance or grandfathering as a C-1 parking lot. The neighborhood is not as appealing a residential one as it was sixty years ago when the current zoning use was determined. Meantime, the development of 27 Avenue as a major commercial street, the expansion of the airport area one mile to the west, and the expansion of the government complex less than a half -mile to the east militate against trying to resume a residential use for the properties within one block of 27 Avenue. 5. Future zoning designation(s): C-1 Statement as to why the proposed zoning designation is appropriate. Re -zoning these two properties is appropriate for the following reasons: a. Said zoning is the highest and best use of the properties. Indeed, Parcel 2 has been used as a parking lot for over 20 years, since the office building on that part of Parcel 2 that is zoned C-1 was built. b. Parcel 2, located at 2700 NW 15 Street, (immediately to the north of Parcel 1) is currently zoned C-1 on its eastern 100' and touching the north boundary of Parcel 1 is the parking area for the large public building on Parcel 2, used as a facility for the State of Florida Department of Children and Families. c. The adjacent property immediately east of Parcel 1 is currently used as a parking lot for the gas station on the corner of NW 27 Avenue and 14 Street, to which it is adjacent, d. Parcel 1 will be used as parking for the building at 2700 NW 15 Street to comply with the lease terms of the State of Florida Department of Children and Families, and the other applicant lessee of the remaining space in the building at 2700 NW 15 Street. This is an appropriate use for the subject property as it enhances the value of the adjacent properties, and their appeal to the users for whom those adjacent properties were intended. e. The two duplexes that were located on the subject property have been demolished due to obsolescence and the cost of repairing the numerous building code Rev. O1--06.O6 3 demolished due to obsolescence and the cost of repairing the numerous building code violations they exhibited when they were bought by petitioner. 6. The property/location listed does not have any open code enforcement/lien violations. 7. At least two photographs that show both parcels are attached (land and improvements). 8. A clear and legible copy of the recorded warranty deed and tax forms of the most current year that shows the present owner(s) and legal description of the property. A copy of the recorded warranty deed and tax forms are attached. (The tax form for one of the two lots in Parcel 1, 2745 NW 14 Street, is not attached, as one was apparently mailed to the former owner, due to a recording error at the records department of Miami -Dade County.) 9. A clear and legible copy of the subject property address and legal description on a separate sheet of paper, labeled as "Exhibit A". 10. Affidavit and disclosure of ownership of the subject property (see pages 4 and 5). Certified list of owners of real estate within 500 feet of the subject property is attached as Exhibit C (see pages 6 and 7). 12. What is the acreage of the project/property site? The acreage of the subject property site is 1.77 acre, or 77,085 square feet. 13. is the property within the boundaries of a historic site, historic district or archeological zone? Please contact the Planning Department on the 3rd Floor for information. The subject property is not within the boundaries of a historic site or district or archeological zone designated pursuant to Chapter 23 of the Miami City Code. 14.
