Pursuant to Article 4, Section 401, (Schedule of District Regulations, Conditional
Principal Use under the Restricted Commercial C-1 District) of Ordinance 11000, as
amended, The Zoning Ordinance of the City of Miami, Florida, the subject proposal has
been reviewed to permit a night club use at the subject property as follows:
This Special Exception Permit encompasses the following special permits:
Class I Special Permit, as per Article 9, Section 906.9, to allow a ground breaking
ceremony.
Class I Special Permit, as per Article 9, Section 916.2.1, to allow temporary parking
for a special event such as groundbreaking ceremony.
The following findings have been made:
• It is found that the proposed use is appropriate for this location near the Miami River
and major public and entertainment facilities near the downtown area, which will
benefit by having a night club use nearby.
• It is found that the subject property consists of two existing warehouse type
commercial structures, of which one will be converted into a night club use. It is also
found that as a result of the requested new nightclub use, the existing parking will not
be sufficient for one of the remaining use and the one being sought as part of this
petition.
s It is found that there are only twenty four (24) onsite parking spaces and the propose
nightclub use would require a total of fifty one (51) parking spaces.
• It is found that (with the exception of the requested parking variance) the subject
proposal has been reviewed and found in compliance with the criteria as set forth in
Section 1305 of Zoning Ordinance 11000.
• It is found that upon compliance with the condition set forth below, this project will
not have any adverse impacts on the surrounding area.
Based on these findings, the Planning .Department is recommending approval of the
application with the following conditions:
1. Approval of this special exception shall run with this operator only; any changes
to a different operator shall require a separate Special Exception.
2. This approval is subject to applicant getting the approval of the variance as a
companion item in this agenda.
3. Paint color samples and sign specifications shall be submitted for review and
approval by the Planning and Zoning Department prior to the issuance of any
building permits.
