HomeMy WebLinkAboutLegislation SR/FR• JStlit !11111 City of Miami Legislation Ordinance City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-02288 Final Action Date: AN ORDINANCE OF THE MIAMI CITY COMMISSION AMENDING CHAPTER 54/ARTICLE II, OF THE CODE OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, ENTITLED "STREETS AND SIDEWALKS/"CONSTRUCTION, EXCAVATION AND REPAIR," MORE PARTICULARLY BY AMENDING SECTION 54-42, ENTITLED "EXCAVATIONS," TO UPDATE THE RESTORATION REQUIREMENTS AND THE COST OF RESTORATION FOR EXCAVATIONS WITHIN PUBLIC STREETS AND SIDEWALKS; CONTAINING A REPEALER PROVISION, A SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the installation of utilities and approved facilities within the public rights -of -way causes damage to the streets and sidewalks; and WHEREAS, the Code of the City of Miami, Florida, as amended ("City Code"), requires the installers of said utilities and approved facilities to properly restore the streets and sidewalks upon completion of the installation of the utilities and approved facilities; and WHEREAS, to ensure that the proper restoration of the streets and sidewalks are completed, the installer is required to provide a payment to the City, based on the cost of the restoration, to be used by the City for the restoration in the event that the installer fails or refuses to complete the restoration work; and WHEREAS, the Miami City Commission, after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to amend the City Code to update the restoration requirements and the cost of restoration for excavations within public streets and sidewalks; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Ordinance are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Chapter 54/Article II/Section 54-42 of the City Code, as amended, entitled "Streets and Sidewalks"/"Construction, Excavation and Repair"/"Excavations," is amended in the following particulars: {1} "CHAPTER 54 STREETS AND SIDEWALKS * Cio' of Miami Page 1 of 3 Printed On: 12/28/2006 File Number: 06-02288 ARTICLE II. CONSTRUCTION, EXCAVATION AND REPAIR Sec. 54-42. Excavations. * * * * * * (b) Calculation of cost of restoration; form of permit. Upon compliance with the terms of subsection (a) of this section, the director of public works shall calculate the cost, when the public works department performs the work of fully restoring the street or sidewalk to the condition in which it is found upon the filing of such application. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the provisions of this Ordinance are repealed. Section 4. If any Section, part of a section, paragraph, clause, phrase or word of this Ordinance is declared invalid, the remaining provisions of this Ordinance shall not be affected.
