AN ORDINANCE OF THE MIAMI CITY COMMISSION AUTHORIZING THE CITY
MANAGER TO ACCEPT AN ADDITIONAL FUNDING CONTRIBUTION OF AN
AMOUNT NOT TO EXCEED $350,000, FROM MIAMI-DADE COUNTY, FOR THE
SOUTH MIAMI AVENUE FROM SOUTHWEST 25TH ROAD TO SOUTHEAST 15TH
ROAD, PROJECT B-60479; CONTAINING A REPEALER PROVISION, A
SEVERABILITY CLAUSE AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, pursuant to Ordinance No. 12622, adopted December 9, 2004, and amended by
Ordinance No. 12696, adopted June 9, 2005, the City Commission authorized the City Manager to
execute a Joint Participation Agreement, with Miami -Dade County ("County"), for South Miami Avenue
roadwork, from Southeast 25th Road to Southeast 15th Road, Miami, Florida, Project B-60479; and
WHEREAS, said Ordinance further authorized the City Manager to accept and appropriate funds
in the amount of $840,000, for use by the City of Miami to construct a roundabout at the intersection
of South Miami Avenue and Southeast 15th Road, Miami, Florida, as well as signage, striping,
roadway and pedestrian lighting, the addition of curb ramps, milling, resurfacing and the replacement
of broken sidewalks, curb and gutters and inlet tops ("Project"); and
WHEREAS, the scope of work is being expanded to include the addition of bicycle lanes and
drainage improvements and, therefore, the County has increased its contribution of funds by
$350,000 from $840,000 to a total contribution of $1,190,000; and
WHEREAS, the City Manager is authorized to accept and appropriate the additional contribution
of $350,000;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble of this Ordinance are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to accept an additional funding contribution of an
amount not to exceed $350,000, from the County for the Project.
Section 3. Ordinance No. 12622, adopted December 9, 2004, and amended by Ordinance No.
12696, adopted June 9, 2005, is amended in the following particulars:{2}

Section 4. All Ordinances or parts of Ordinances that are inconsistent or in conflict with the
provisions of this Ordinance are repealed.
Section 5. If any section, part of section, paragraph, clause, phrase or word of this Ordinance is
declared invalid, the remaining provisions of this Ordinance shall not be affected.
Section 6. This Ordinance shall become effective immediately upon its adoption and signature of
the Mayor.{3}

{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.

{3} This Ordinance shall become effective as specified herein unless vetoed by the Mayor within ten
days from the date it was passed and adopted. If the Mayor vetoes this Ordinance, it shall become
effective immediately upon override of the veto by the City Commission or upon the effective date
stated herein, whichever is later.
