B-50690, WITH THE CITY OF MIAMI'S REQUIRED MATCHING FUNDS, IN AN AMOUNT NOT TO EXCEED $131,222, ALLOCATED FROM CAPITAL IMPROVEMENT PROGRAM PROJECT NO. B-50690-NORTHEAST 71 STREET STORM SEWER PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE FEDERALLY FUNDED SUBGRANT AGREEMENT, IN SUBSTANTIALLY THE ATTACHED FORM, AND ANY OTHER NECESSARY DOCUMENTS FOR SAID PURPOSE. WHEREAS, the City of Miami ("City") has established capital improvement projects to improve the drainage in various communities throughout the City; and WHEREAS, the City has been awarded a grant in the amount of $393,666, by the State of Florida, Division of Emergency Management ("DEM") to improve the drainage area referred to as the Northeast 71 st Street Storm Water System; and WHEREAS, matching funds from the City in the amount of $131,222, are required as a condition of the grant, and are available from the City's Capital Improvement Program, Project No. B-50690 -Northeast 71 Street Storm Sewer Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. A grant award from DEM, in an amount not to exceed $393,666, for the Northeast 71 st Street Storm Sewer Project, Project B-50690, is accepted. Section 3. The required matching funds, in an amount not to exceed $131,222 were allocated from Capital Improvement Project No. B-50690-Northeast 71 st Street Storm Sewer Project, pursuant to Resolution No. 06-0730, adopted December 14, 2006, as amended, which approved new appropriations constituting an update to the Multi -Year Capital Plan approved by Resolution No. 06- 0335, adopted May 25, 2006. Section 4. The City Manager is authorized{1} to execute the Federally Funded Subgrant Agreement, in substantially the attached form, and any other necessary documents for said purpose. Section 5. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten (10) calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
