A RESOLUTION OF THE MIAMI CITY COMMISSION, BYA FOUR -FIFTHS (4/STHS)
AFFIRMATIVE VOTE, AFTER AN ADVERTISED PUBLIC HEARING, RATIFYING,
APPROVING AND CONFIRMING THE CHIEF PROCUREMENT OFFICER'S
DETERMINATION AND FINDING AND THE CITY MANAGER'S FINDING OF A SOLE
SOURCE; WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING
PROCEDURES AND APPROVING THE SOLE SOURCE PURCHASE OF
TWENTY-TWO (22) WEATHERBUG WEATHER SYSTEMS AND ACCESSORIES
(INCLUDING EQUIPMENT, TRAINING, INSTALLATION, WARRANTY, SUPPORT
SERVICES, AND MAINTENANCE), FOR THE DEPARTMENT OF FIRE -RESCUE,
FROM AUTOMATED WEATHER SOURCE (AWS) CONVERGENCE
TECHNOLOGIES, INC., FORA TOTAL CONTRACT AMOUNT NOT TO EXCEED
$185,200; ALLOCATING FUNDS FROM THE FEDERAL GRANT ENTITLED,
"URBAN AREA SECURITY INITIATIVE" (UASI) GRANT; AND AUTHORIZING AND
DIRECTING THE CITY MANAGER TO UNDERTAKE ANY NECESSARY RELATED
PROCEDURES FOR LICENSES, PERMITS AND REQUIREMENTS AND TO
NEGOTIATE AND TO EXECUTE ANY NECESSARY DOCUMENTS AND
AGREEMENTS FOR SAID PURPOSES.
WHEREAS, the proposed WeatherBug Weather System with accessories (including equipment,
training, installation, warranty, support services, and maintenance), will provide the City of Miami's
("City") Emergency Operations point -specific weather information by streaming live outside data into a
network for users to receive real-time data and receive seamlessly live camera images which will
assist the City's First Responders to prepare for and respond to any manmade or natural disaster
appropriately and safely; and
WHEREAS, this system will entail twenty-two (22) permanent integrated locations throughout the
City, providing coverage in all of the City's districts; and
WHEREAS, pursuant to Section 18-92 of the Code of the City of Miami, Florida, as amended (the
"Code"), the Chief Procurement Officer has made a determination and adopted a finding that the
WeatherBug Weather System is a sole source; and therefore, competitive bidding methods is not
practicable because the system's manufacturer, AWS Convergence Technologies Inc., has installed
and operates 271 WeatherBug stations in Florida and over 34 existing stations in Miami -Dade and
Broward County creating a regional presence within South Florida critical to how Miami -Dade and
Broward County public agencies can share information preparing for an emergency response; and
WHEREAS, other public agencies such as the Broward Emergency Management Agency,
Broward Sheriff's Office, City of Ft. Lauderdale, City of Miami Beach, and Miami -Dade County Office
of Emergency Management have also purchased the WeatherBug Weather System as a sole source;
and
WHEREAS, the determination and finding of the Chief Procurement Officer has been approved

and adopted as the finding of the City Manager;
WHEREAS, the City Manager and the Chief of Fire -Rescue recommend that the requirements for
formal competitive sealed bidding procedures be waived and the procurement of the above
equipment, training, installation, warranty, support services, and maintenance, as specified be
approved; and
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA;
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. By a four -fifths (4/5ths) affirmative vote, after an advertised public hearing, the Chief
Procurement Officer's determination and finding and the City Manager's finding of a sole source,
waiving the requirements for competitive sealed bidding procedures, pursuant to Section 18-92 of the
Code, is ratified, approved and confirmed, and the sole source purchase of twenty-two (22)
WeatherBug Weather Systems and accessories (including equipment, training, installation, warranty,
support services, and maintenance), for the Department of Fire -Rescue, from Automated Weather
Source (AWS) Convergence Technologies, Inc., for a total contract amount not to exceed $185,200,
with funds allocated from the Federal grant entitled, "Urban Area Security Initiative" (UASI) grant
program is hereby approved.
Section 3. The City Manager is authorized and directed to undertake any necessary related
procedures for licenses, permits and requirements and to negotiate and execute any necessary
documents and agreements for said purposes.
Section 4. This Resolution shall become effective immediately upon its adoption and signature of the
Mayor. {1}
Footnotes:
{1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
