HomeMy WebLinkAboutR-07-0018City of Miami Legislation Resolution: R-07-0018 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-02299 Final Action Date: 1/11/2007 A RESOLUTION OF THE MIAMI CITY COMMISSION AUTHORIZING THE PRESIDENT/CHIEF EXECUTIVE OFFICER OF THE LIBERTY CITY COMMUNITY REVITALIZATION TRUST TO PAY CHEROKEE ENTERPRISES, INC., THE AMOUNT OF $110,000, FOR SOURCE REMOVAL ACTIVITIES AND POST EXCAVATION AND NATURAL ATTENUATION MONITORING; ALLOCATING SAID FUNDS FROM PROJECT NO. 93-110159, WITH SAID FUNDS REIMBURSABLE THROUGH THE UNITED STATES ENVIRONMENTAL PROTECTION AGENCY BROWNFIELDS ASSESSMENT AND CLEANUP COOPERATIVE GRANT. WHEREAS, the Liberty City Community Revitalization Trust ("Liberty City Trust") is responsible for oversight of and shall facilitate, the City of Miami's ("City's") revitalization effort for the redevelopment of the Liberty/Model City area; and WHEREAS, as part of Ordinance No. 12859, adopted October 12, 2006, creating the Liberty City Trust, the Trust cannot contract and/or be contracted for an amount that exceeds $5,000, per items, goods, services, and/or anything of value in one transaction or multiple transactions concerning the same subject matter; and WHEREAS, any and all contracts above $5,000, shall require City Commission approval; and WHEREAS, the President/Chief Executive Officer ("CEO") is seeking authorization from the City Commission to disburse payment in the amount of $110,000, to Cherokee Enterprises, Inc., for remediation services for the property located at 1199 Northwest 62nd Street, Miami, Florida; and WHEREAS, said funds are allocated from Project No. 93-110159; and WHEREAS, said funds are reimbursable under the United States Environmental Protection Agency ("U.S. EPA") Brownfields Assessment and Cleanup Cooperative Grant; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted and reference and incorporated herein as if fully set forth in this Section. Section 2. The President/CEO is authorized to pay Cherokee Enterprises, Inc., the amount of $110,000, for source removal and post excavation and natural attenuation monitoring, with funds allocated from Project No. 93-110159. Section 3. Said funds, are reimbursable through the U.S. EPA Brownfields Assessment and Cleanup Cooperative Grant. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
