HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-02283 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AUTHORIZING THE CITY MANAGER TO NEGOTIATE AND TO EXECUTE AN IMPROVEMENTS AND INDEMNIFICATION AGREEMENT WITH THE TURKEL RESOURCE FOUNDATION, INC., ("FOUNDATION"), IN SUBSTANTIALLY THE ATTACHED FORM, IN ORDER FOR THE FOUNDATION TO COMPLETE THE IMPROVEMENTS AT THE CITY OF MIAMI ("CITY") OWNED PROPERTY LOCATED AT 100 NORTHWEST 17 STREET, MIAMI, FLORIDA, COMMONLY KNOWN AS THE DORSEY MEMORIAL LIBRARY SUBJECT TO THE FOUNDATION PROVIDING INSURANCE DEEMED APPROPRIATE BY THE CITY'S DEPARTMENT OF RISK MANAGEMENT. WHEREAS, the City of Miami ("City") is the owner of real property located at 100 Northwest 17 Street, Miami, Florida, commonly known as the Dorsey Memorial Library ("Library"); and WHEREAS, on September 25, 2003, the City Commission adopted Resolution No. 03-1027, accepting a donation of in -kind services from the Turkel Resource Foundation, Inc. ("Foundation"), consisting of $50,000 worth of improvements to the Library; and WHEREAS, the Foundation was able to clean and secure the Library building, prepare plans and specifications for the Project and receive preliminary cost estimates; and WHEREAS, the Department of Capital Improvements and Transportation ("CIT") received a commitment of funds from the Miami -Dade County Building Better Communities General Obligation Bond "(GOB") in the amount of Two Hundred and Fifty Thousand Dollars ($250,000) for the capital project B-30531, Dorsey Memorial Library Restoration ("Project"), also known as Miami -Dade County GOB Project No. 256-70545; and WHEREAS, Resolution No. 06-0611, adopted October 12, 2006, by the City Commission authorized the City Manager to appropriate the GOB funds in the total amount of $250,000 for Project B-30531; and WHEREAS, Resolution No. 06-0702, adopted December 14, 2006, by the City Commission authorized a $250,000 grant from the City to the Foundation to continue restoration of the Library and authorized the City Manager to execute a Project Co-operation Agreement; and WHEREAS, the Foundation is poised to continue with the restoration of the Library utilizing the GOB funds and the City is pleased with the performance of the Foundation and has granted the GOB funds to the Foundation to continue with the improvements; and WHEREAS, said improvements consist of certain repairs and/or improvements to sidewalks, City of Miami Page 1 of 2 Primed On: 1/2/2007 File Number: 06-02283 concrete work, carpentry, lumber, masonry, doors and frames, insulation, hardware, windows, shutters, lath and plaster, drywall, wood floors, ceramic tiles, painting, plumbing, HVAC, electric including project administration and design but not limited to these improvements ("Improvements"); and WHEREAS, the Foundation wishes to contract for the appropriate professional, construction and other services and oversee the work of the Improvements, at no cost to the City; and WHEREAS, upon completion of the work, the Library will be a restored as a resource center of African -American history in Florida; and WHEREAS, it is the intention of the City to secure an arrangement with the Miami -Dade County Public Libraries through an inter-Iocal agreement, to operate the Library as a resource center; and WHEREAS, the Foundation agrees to prepare the Library in accordance with the specifications, as required by the Miami -Dade County Public Libraries, attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. The City Manager is authorized{1} to negotiate and to execute an Improvements and Indemnification Agreement with Turkel Resource Foundation, Inc., ("Foundation"), in substantially the attached form, in order for the Foundation to complete the improvements at the City of Miami ("City") owned property located at 100 Northwest 17 Street, Miami, Florida, commonly known as the Dorsey Memorial Library subject to the Foundation providing insurance deemed appropriate by the City's Department of Risk Management. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{2} APP'OVED AS TO FORM AND CORRECTNESS: •R E .
