A RESOLUTION OF THE MIAMI CITY COMMISSION, AUTHORIZING AN
INCREASE IN AN AMOUNT NOT TO EXCEED $17,497.81 IN THE ORIGINAL
CONTRACT PREVIOUSLY AWARDED TO ULTIMATE POOLS, INC., AND
AMENDING RESOLUTION NO. 06-0173, ADOPTED MARCH 23, 2006,
ACCEPTING THE BID OF ULTIMATE POOLS, INC., PURSUANT TO INVITATION
FOR BIDS NO. 05-06-027, FOR THE SWIMMING POOL FACILITY RENOVATION
AT THE MIAMI ROWING CLUB, FOR THE DEPARTMENT OF PARKS AND
RECREATION, RATIFYING A CHANGE TO THE SCOPE OF WORK OF THE
CONTRACT AND WORK PERFORMED, RESULTING IN A SUBSEQUENT CHANGE
ORDER TO INCLUDE THE INSTALLATION OF NEW TRANSFORMERS, A LIGHT
POLE, RECEPTACLE, CONDUITS, WIRING, CIRCUITS AND ELECTRICAL PANEL,
THEREBY INCREASING THE TOTAL CONTRACT AMOUNT FROM $239,125.00 TO
$256,622.80; ALLOCATING FUNDS FOR THE SAID INCREASE FROM THE PARKS
DEPARTMENT CONSOLIDATED ACCOUNT PROJECT NO. 20-116002, TASK-01,
AWARD-1179; AND AUTHORIZING THE CITY MANAGER TO EXECUTE SUCH
CHANGE ORDER FOR SUCH PURPOSE.
WHEREAS, Resolution No. 06-0173, adopted March 23, 2006, authorized the renovation of the
swimming pool at the Miami Rowing Club, by Ultimate Pools, Inc., pursuant to Invitation for Bids No.
05-06-027, for the Department of Parks and Recreation, for a total contract amount not to exceed
$239,125; and
WHEREAS, it has been determined that a simple replacement of the existing electrical panel was
not appropriate; and
WHEREAS, an electrical engineer was hired to determine and calculate the appropriate electrical
loads for the new electrical motors, chemical feeders, receptacles, lighting, electrical panel and
circuits; and
WHEREAS, the existing conduit scheduled to be retained for use between the main panel and the
new replacement panel was found to be in disrepair and unusable; and
WHEREAS, testing and inspecting the underwater pool lights, revealed that the existing
transformers were found to be in a dangerous state of degradation and rusted, with many conduits
broken at the connections; and
WHEREAS, new transformers are necessary to ensure a non -hazardous light function and to meet
the requirement set forth by the Florida Department of Health for lighting sufficiency at the pool
mechanical area by installing a new light pole and associated circuit breakers, conduit, wiring, and
GFCI receptacle; and

WHEREAS, ratification to the change of the scope of the work of the contract and work performed
is required, resulting in a subsequent change order to include said services already performed;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA;
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. An increase in an amount not to exceed $17,497.81 in the original contract previously
awarded to Ultimate Pools, Inc. is authorized.
Section 3. Resolution No. 06-0173, adopted March 23, 2006, is amended in the following
particulars:{1}

Section 3. "A Resolution of the Miami City Commission accepting the bid
of Ultimate Pools, Inc., pursuant to Invitation for Bids No. 05-06-027,
received February 6, 2006 for the Swimming Pool Facility Renovation at
the Miami Rowing Club, for the Department of Parks and Recreation, for
a total contract award amount not to exceed $239,125 $256,622.80;
allocating funds from Capital Improvement Project Account No. 331369.
Section 4. Funds for said increase are allocated from the Parks Department Consolidated Account
Project No. 20-116002, TASK-01, AWARD-1179.
Section 5. The City Manager is authorized{2} to execute such change order for such purpose.
Section 6. This Resolution shall become effective immediately upon adoption and signature of the
Mayor.{3}

{2} The herein authorization is further subject to compliance with all requirements that may be

{3} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
