Notice is hereby given that the City Commission of the City of Miami,
Florida, will consider the following ordinance on second and final reading
on January 11, 2007, commencing at 9:00 a.m., in the City Commission
Chambers located at 3500 Pan American Drive, Miami, Florida:
ORDINANCE
AN ORDINANCE OF THE MIAMI CITY COMMISSION, AMEND-
ING CHAPTER 54 OF THE CITY OF MIAMI, FLORIDA, AS
AMENDED, ENTITLED "STREETS AND SIDEWALKS," BY
AMENDING SECTION 54-1, TO ADD A DEFINITION OF
"EXEMPT GOVERNMENT PROPERTY, " AND AMENDING
SECTION 54-6.2(A), TO REQUIRE A PERMIT FOR AN
ASSEMBLY AT AN EXEMPT GOVERNMENT PROPERTY;
CONTAINING A REPEALER PROVISION, A SEVERABILITY
CLAUSE, AND PROVIDING FOR AN IMMEDIATE EFFECTIVE
DATE.
Said proposed ordinance may be inspected by the public at the Office of
the City Clerk, 3500 Pan American Drive, Miami, Florida, Monday
through Friday, excluding holidays, between the hours of 8 a.m. and 5
p.m., or at http://www.miamigov.com/Agendas/pubmeet.asp, five
days before the date of the Commission Meeting.
All interested persons may appear at the meeting and may be heard with

NOTICE OF PUBLIC HEARING
The Miami City Commission will hold a Public Hearing on January 11,
2007 to consider the execution of Amendment Number Five (5) to the
existing Bus Bench Design, Installation and Maintenance Agreement, as
previously amended, (collectively the "Original Agreement") between the
City of Miami and FUEL Miami LLC, and FUEL Outdoors Holdings LLC;
and to consider the City Manager's recommendations and findings that
Florida Statute Section 337.408 does not require a competitive bid, that
pursuant to City Code Section 18-85(a) competitive negotiation methods
are not practicable or advantageous to the City, and that instead of
utilizing a new competitive bid, the new bus shelter provisions should be
added to the existing Original Agreement.
This action is being considered pursuant to Section 18-85 (a) of the City
Code, of the City of Miami, Florida, as amended, and requires a 4/5ths
affirmative vote of the Miami City Commission after a duly advertised public
hearing. The recommendations and findings to be considered in this matter
are set forth in the proposed resolution and in this Code Section, which are
deemed to be incorporated by reference herein and are
available as public records from the City of Miami. The Public Hearing will be
held in conjunction with the regularly scheduled City Commission meeting of
January 11, 2007, commencing at 9:00 a.m. in the City Commission
Chambers located at City Hall, 3500 Pan American Drive, Miami, Florida.
All interested persons are invited to appear and may be heard concerning
such proposed acquisition. Should any person desire to appeal any

rida celebrara una audiencia publica el 11 de enero
del 2007, a las 9:00 a.m. en el Ayuntamiento de Miami

La Junta de Comisionados se la Ciudad de Miami, cele-
brara una Audiencia Publica el 11 de enero del 2007,
para tratar la ejecucion de la Enmienda Numero Cinco
(5) al Diseiio de Bancos de Autobuses existente, Contrato
de Instalacion y Mantenimiento, segunpreviamente en-
mendada, (colectivamente el "Contrato Original" ("Original
Agreement") entre la Ciudad de Miami y FUEL Miami LLC
y FUEL Outdoors Holdings LLC; y para considerar las re-
comendaciones del Administrador de la Ciudad de que la
Seccion 337.408 de los Estatutos de la Florida no requie-
ren licitacion competitiva, que segun la Seccion 18-85
(a) del Codigo de la Ciudad no resulta pratico el metodo
de negociacion competitiva o ventajoso para la Ciudad y
que, en lugar de utilizar una nueva licitacion competitiva,
deberfan adicionarse las nuevas provisiones de los alber-
gues de autobuses al Contrato Original.
Se toma esta accion de acuerdo con la Seccion 18-85 (a)
del Codigo de la Ciudad de Miami, Florida, segun enmien-
da, y requiere un voto afirmativo de 4/5 de los Comisio-
nados de la Ciudad de Miami, despues de una audiencia
publica debidamente anunciada. Las recomendaciones y
descubrimientos a ser considerados en este asunto se ex-
presan en la resolucion propuesta y en esta Seccion del
Codigo, los que habran de incorporarse mediante refe-
rencia aqui y estan disponibles como record publico en
la Ciudad de Miami. Esta Audiencia Publica se celebrara
conjuntamente con la reunion ordinaria de la Junta de
Comisionados senalada para el 11 de enero del 2007,
comenzando a las 9:00 a.m. en los Salones de la Junta
de Comisionados situados en el ayuntamiento (City Hall),
3500 Pan American Drive, Miami, Florida.
Se invita a comparecer y ser oidas a todas las personas
interesadas en el asunto propuesto. Si alguna persona
deseara apelar cualquier decision de la Junta de Comi-
sionados en relacion a cualquier asunto tratado en esta
reunion, dicha persona debera asegurarse de que se pro-

waiving the requirements of obtaining sealed bids for the sole source
purchase of twenty-two (22) WeatherBug Weather . Systems and
accessories (including equipment, training, installation, warranty,
support services, and maintenance), for the Department of Fire -Rescue,
from Automated Weather Source (AWS), a Non-Minority/Non-Local
vendor, located at 12410 Milestone Center Drive, Suite 300,
Germantown, MD 20876, for the Department of Fire -Rescue, in an
amount not to exceed $185,200.

they might be able to satisfy the City's requirement for this item may
