HomeMy WebLinkAboutR-06-0731City of Miami Legislation Resolution: R-06-0731 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-02170 Final Action Date: 12/14/2006 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), BYA FOUR -FIFTHS (4/STHS) AFFIRMATIVE VOTE, RATIFYING, APPROVING AND CONFIRMING THE CITY MANAGER'S EMERGENCY FINDING, WAIVING THE REQUIREMENTS FOR COMPETITIVE SEALED BIDDING PROCEDURES, PURSUANT TO SECTION 18-90 OF THE CODE OF THE CITY OF MIAMI, FLORIDA; AUTHORIZING THE PURCHASE OF PARADE PRODUCTION SERVICES FOR THE MIAMI HEAT CELEBRATION PARADE FROM PETE DIAZ PRODUCTIONS, INC., IN AN AMOUNT NOT TO EXCEED $89,000; ALLOCATING FUNDS FROM THE FISCAL YEAR 2005-2006, ACCOUNT CODE NO. 001000.980000.548000. WHEREAS, the Miami Heat during the 2005-2006 National Basketball Association ("NBA") basketball season made a successful run towards the NBA Championship Finals; and WHEREAS, in the finals, the Miami Heat faced the Dallas Mavericks and overcame a two games to zero deficit by winning four consecutive games to win the NBA Championship; and WHEREAS, as a result, the Miami Heat and the City of Miami ("City") partnered to provide for a Miami Heat Championship Celebration Parade on Biscayne Boulevard for the general public to attend; and WHEREAS, the parade logistics were planned within twenty-four hours after the Miami Heat won Game 6 of the NBA Finals defeating the Dallas Mavericks 95-92; and WHEREAS, the quick turn around time to provide for a parade did not allow sufficient time for the City to conduct a formal competitive sealed bidding process required by Section 18-85 of the Code of the City of Miami, Florida, as amended ("City Code"); and WHEREAS, in lieu of a formal competitive sealed bidding process, the Department of Purchasing still managed to conduct an informal competitive process in which five (5) vendors were contacted to participate in the process to provide parade production services consisting of staging services, sound services, and special effects; and WHEREAS, three (3) vendors responded to the solicitation and the lowest responsive, responsible bidder was Pete Diaz Productions, Inc., in the amount not to exceed $89,000; and WHEREAS, the actual proposal and invoice submitted by Pete Diaz Productions, Inc. are attached providing for a line item breakdown of the items, equipment, and services delivered for the parade held back on June 23, 2006; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: City of Miami Page 1 of 2 File Id: 06-02170 (Version: 11 Printed On: 3/6/2017 File Number: 06-02170 Enactment Number: R-06-0731 Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. By a four -fifths (4/5ths) affirmative vote, the City Manager's emergency finding, waiving the requirements for competitive sealed bidding procedures, pursuant to Section 18-90 of the City Code, is ratified, approved and confirmed for the purchase of parade production services for the Miami Heat Parade from Pete Diaz Productions, Inc., in an amount not to exceed $89,000, with funds allocated from the Fiscal Year 2005-2006, Account Code No. 001000.980000.548000. Section 3. This Resolution shall become effective immediately upon its adoption and signature of the Mayor.{1} Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become effective immediately upon override of the veto by the City Commission.
