HomeMy WebLinkAboutLegislationCity of Miami Legislation Resolution City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com File Number: 06-02167 Final Action Date: A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), MAKING APPROPRIATIONS RELATING TO CAPITAL PROJECTS FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 2007; FURTHER AMENDING PRIOR YEAR APPROPRIATIONS TO CONTINUE PREVIOUSLY APPROVED PROJECTS. WHEREAS, new sources of revenues have been identified for capital projects for the Fiscal Year ending September 30, 2007, and require appropriation into their respective capital funds; and WHEREAS, the new appropriations constitute an update to the existing Multi -Year Capital Plan approved by Resolution No. 06-0335, adopted May 25, 2006; and WHEREAS, the capital funds contained herein reflect the new chart of accounts adopted with the implementation of the Oracle Financial Management System; and WHEREAS, previous appropriations made for capital projects by Resolution No. 05-0689, adopted November 17, 2005, as amended, have been translated to the capital funds in the Oracle system based on the new chart of accounts; and WHEREAS, the previous appropriations remain authorized to continue previously approved capital projects; and WHEREAS, select previous appropriations are being reallocated within Capital Funds; and WHEREAS, it is now in order to approve appropriations for new sources of revenues for Fiscal Year 2007 and amend prior year appropriations in Capital Funds based on the following format: Fund 30000 Community Redevelopment Area Fund 31000 General Government Fund 32000 Public Safety Fund 33000 Disaster Recovery Fund 34000 Public Facilities Fund 35000 Parks & Recreation Fund 36000 Streets & Sidewalks Fund 37000 Sanitary Sewers Fund 38000 Storm Sewers City of Miami Page 1 of 4 Printed On: 1214/2006 File Number, 06-02167 Fund 39000 Solid Waste Fund 39900 Mass Transit; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The herein appropriations are hereby made for implementation of municipal capital improvements of the City of Miami ("City") , for the Fiscal Year ending September 30, 2007. The herein appropriations are hereby designated by reference to capital fund and sources of revenues. Descriptive project title and number, when included, are shown for informational purposes only. The appropriations herein are the anticipated expenditure requirements for the City, but are not mandatory should unexpected difficulties arise in the planning, design, construction, and administration of projects, or if altered economic conditions indicate that a curtailment in certain expenditures is necessary or desirable for the general welfare of the City. The City Manager or his designee is specifically authorized to transfer revenues between projects within the same capital fund and to withhold any of these appropriated revenues from encumbrance or expenditure should such action appear advantageous to the City. Except as herein provided, transfer of revenues between capital funds shall be authorized only by resolution amendatory hereto. The City Manager is directed to file with the City Clerk and the County Clerk a statement of the proposed expenditures and estimated revenues for fiscal year 2007, which shall be entitled "Capital Budget of the City of Miami, the Fiscal Year October 1, 2006 through September 30, 2007." Section 4. (a) The City Manager is authorized{1} to invite or advertise bids for the purchase of any material, equipment, or physical improvement embraced in the aforementioned appropriations or which may be provided for in accordance with the provisions of Section 2 hereof, for which formal bidding is required; such bids to be returnable to the City Commission or the City Manager in accordance with Charter or Code provisions. (b) Further, expenditure of the herein appropriated revenues is authorized in the procurement of goods and services by award of contract for the same by the City Commission following the use, if applicable, of competitive negotiations unless the award of such contract by the City Manager is expressly allowed under the City Code provisions. Section 5. This Resolution shall become effective immediately upon its adoption and signature by the Mayor.{2} APPROVED AS TO FORM AND CORRECTNESS: JORGE L. FERNANDEZ CITY ATTORNEY Footnotes: {1} The herein authorization is further subject to compliance with all requirements that may be imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter and Code provisions. {2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar days from the date it was passed and adopted.
