Director City Manager AGENDA SUMMARY FORM ATTACHMENT Subject: Resolution Authorizing Payment of FY'06-07 Miami Dade Scale Fees Background Information: The City of Miami entered into an Interlocal Agreement with Miami -Dade County for the use of the County's Solid Waste Management System Facilities for disposal of certain solid waste materials collected in and by the City of Miami. The Interlocal Agreement established the fees for disposal and transfer of materials collected in and by the City at $56.05 per ton, $11.05 per ton for transfer or totaling $67.10 per ton at the Resource Recovery, Landfill or Transfer Facilities respectively. The estimated amount for disposal fees will not exceed $10,000,000.00 and cannot be increased without prior approval of the City's Office of Strategic Planning, Budgeting and Performance. Page 2 of 2 Administrative Order Administrative Order No.: 4-68 Title: Schedule of all Service Levels and Fees for the Miami -Dade County Department of Solid Waste Management Ordered: 09/20/06 Effective: 10/01/06 AUTHORITY: Section 4.02 of the Miami -Dade County Home Rule Amendment and Charter and Chapter 15 of the Code of Miami -Dade County. SUPERSEDES: This Administrative Order (AO) supersedes AO 4-68, ordered September 22, 2005 and effective October 1, 2005. POLICY: This Administrative Order provides a schedule of all solid waste service levels and fees. PROCEDURE: The administration of this Administrative Order is designated to the Director, Miami -Dade County Department of Solid Waste Management, who shall be responsible for the collection of fees and the delivery of the required services pursuant to Chapter 15 relating to the powers and duties of the Department of Solid Waste Management. Every year, or earlier, if need be, the Director shall review all fees in terms of cost and recommend necessary changes to the County Manager through this administrative order procedure. DEFINITIONS: Contract Disposal — use of the County Solid Waste Management System by any person, governmental entity, corporation or partnership that has entered into an Agreement with the County of ten (10) years or greater in duration for such County Solid Waste Management System use. Short Term Disposal — use of the County Solid Waste Management System by any person, governmental entity, corporation or partnership that has not entered into an Agreement with the County of ten (10) years or greater in duration for such County Solid Waste Management System use. Municipal Solid Waste (MSW) — any solid waste, except for sludge, resulting from the operation of residential, commercial, governmental or institutional establishments that would normally be collected, processed, and disposed of through a public or private solid waste management service. The term includes yard trash, but does not include solid waste from industrial, mining or agricultural operations [Section 403.706(5) F.S.]. Recovered Materials — means metal, paper, glass, plastic, textile or rubber materials that have known recycling potential, can be feasibly recycled, and have been diverted and source separated or have been recovered from the solid waste stream for sale, use, or reuse as raw materials, whether or not the materials require subsequent processing or separation from each other, but does not include materials destined for any use that constitutes disposal. Recovered materials as described above are not solid waste [Section 403.703(7) F.S.I. FEE SCHEDULE: The fee schedule adopted by this Administrative Order is attached hereto and made a part hereof. This official fee schedule is also filed with and subject to the approval of the Board of County Commissioners and on file with the Clerk thereof. Fees that are charged by the Department of Solid Waste Management shall be the same as those listed in the official fee schedule on file with the Clerk of the County Commission. This Administrative Order is hereby submitted to the Board of County Commissioners of Miami -Dade County, Florida.
