A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S),
AUTHORIZING THE CITY MANAGER TO CONVEY, AT NO COST TO THE STATE
OF FLORIDA, DEPARTMENT OF TRANSPORTATION, THE FOLLOWING FOUR (4)
PARCELS OF LAND TO BE USED FOR TRANSPORTATION PURPOSES: PARCEL
1, LOCATED AT 503 NORTHWEST 7TH AVENUE, PARCEL 2, LOCATED AT 472
NORTHWEST NORTH RIVER DRIVE, AND PARCEL 3, LOCATED ON THE
SOUTHWESTERLY APPROACH TO THE NORTHWEST 5TH STREET BRIDGE,
CONTAINING AN AGGREGATE AREA OF 5,701 SQUARE FEET MORE OR LESS,
AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "A," ATTACHED AND
INCORPORATED, COLLECTIVELY REFERRED TO AS PARCEL 103.1, SUCH
CONVEYANCE TO BE BY CITY DEED; IN ADDITION, PARCEL 4, LOCATED AT
470 NORTHWEST NORTH RIVER DRIVE, CONTAINING AN AGGREGATE AREA
OF 2,421 SQUARE FEET MORE OR LESS, AS MORE PARTICULARLY
DESCRIBED IN EXHIBIT "B," ATTACHED AND INCORPORATED, REFERRED TO
AS PARCEL 103.2, SUCH CONVEYANCE TO BE BY QUITCLAIM DEED;
FURTHER AUTHORIZING THE CITY MANAGER TO GRANT A TEMPORARY
EASEMENT FOR THE RIGHT TO USE APPROXIMATELY 3,761 SQUARE FEET
MORE OR LESS OF SUBMERGED LAND, AS MORE PARTICULARLY DESCRIBED
IN EXHIBIT "C," ATTACHED AND INCORPORATED, REFERRED TO AS PARCEL
702, FOR A PERIOD BEGINNING WITH THE DATE OF EXECUTION OF SUCH
TEMPORARY EASEMENT AND CONTINUING UNTIL COMPLETION OF THE
PROJECT, BUT NOT TO EXCEED ONE YEAR, TO FACILITATE THE MOVING OF
CONSTRUCTION EQUIPMENT DURING THE REPLACEMENT OF THE BRIDGE
AND THE ASSOCIATED ROADWAY IMPROVEMENTS IN CONNECTION WITH
THE NORTHWEST 5TH STREET BRIDGE RECONSTRUCTION PROJECT;
FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE CONVEYANCE
DOCUMENTS, IN SUBSTANTIALLY THE ATTACHED FORM, AND ALL ADDITIONAL
DOCUMENTS THAT MAY BE NECESSARY TO EFFECTUATE SAID
CONVEYANCES.
WHEREAS, the State of Florida Department of Transportation ("FDOT") is finalizing plans for the
construction and improvement of the Northwest 5th Street Bridge Reconstruction Project also known
as State Road No. 7, Item No. 4128081, in Miami -Dade County, Florida; and
WHEREAS, the City of Miami ("City") is the owner of the following parcels of land: the properties
located at 503 Northwest 7th Avenue and 472 Northwest North River Drive, and certain property on
the southwesterly approach to the Northwest 5th Street Bridge, as legally described on Exhibit "A,"
attached, containing an aggregate area of 5,701 square feet more or less (hereinafter collectively
referred to as "Parcel 103.1"), the property located at 470 Northwest North River Drive, as legally
described on Exhibit "B," attached, containing an aggregate area of 2,421 square feet more or less
(hereinafter referred to as "Parcel 103.2"), and the submerged land area located along North River
Drive on the westerly approach to the Northwest 5th Street Bridge, containing approximately 3,761

square feet more or less, as legally described on Exhibit "C" (hereinafter referred to as "Parcel 702");
and
WHEREAS, FDOT has requested fee simple ownership of Parcel 103.1 and Parcel 103.2 to be
used for transportation purposes in connection with the Northwest 5th Street Bridge Reconstruction
Project; and
WHEREAS, FDOT has also requested a temporary easement on Parcel 702, the submerged land
area, to move construction equipment during the replacement of the bridge and the associated
roadway improvements; and
WHEREAS, it is necessary that these parcels now owned by the City and not needed for City
purposes be provided to FDOT to enable the construction and improvements by FDOT of the
Northwest 5th Street Bridge in order to serve the best interest and the general welfare of the City and
its inhabitants; and
WHEREAS, the deeds and the temporary easement shall contain reverter provisions providing
that if these parcels are abandoned or said project is discontinued, FDOT ownership and easement
rights shall cease and revert back to the City; and
WHEREAS, FDOT has agreed to design and construct a Riverwalk underneath the bridge as part
of the Northwest 5th Street Bridge Reconstruction Project, which will include the enhancement of any
and all remnant areas adjacent to the Riverwalk with a passive park atmosphere that will be
compatible with the City's Riverwalk Project;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI,
FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by
reference and incorporated as if fully set forth in this Section.
Section 2. The City Manager is authorized{1} to convey to FDOT, by City Deed, in substantially
the attached form, Parcel 103.1, consisting of the properties located at 503 Northwest 7th Avenue
and 472 Northwest North River Drive, and certain property on the southwesterly approach to the
Northwest 5th Street Bridge, containing an aggregate area of 5,701 square feet more or less, as
more particularly described in Exhibit "A," and by Quitclaim Deed, in substantially the attached form,
Parcel 103.2, consisting of the property located at 470 Northwest North River Drive, containing an
aggregate area of 2,421 square feet more or less, as more particularly described in Exhibit "B," to be
used in connection with the Northwest 5th Street Bridge Reconstruction Project.
Section 3. The City Manager is authorized{1} to grant a temporary easement on the submerged
land referred to as Parcel 702, containing approximately 3,761 square feet more or less and more
particularly described in Exhibit "C," to be used to move construction equipment during the
replacement of the bridge and associated roadway improvements.
Section 4. The City Manager is further authorized{1} to execute conveyance documents, in
substantially the attached form, and all additional documents which are necessary to effectuate said
conveyances.

Section 5. This Resolution shall become effective immediately upon its adoption and signature of
the Mayor.{2}
Footnotes:
{1} The herein authorization is further subject to compliance with all requirements that may be
imposed by the City Attorney, including but not limited to those prescribed by applicable City Charter
and Code provisions.
{2} If the Mayor does not sign this Resolution, it shall become effective at the end of ten calendar
days from the date it was passed and adopted. If the Mayor vetoes this Resolution, it shall become
effective immediately upon override of the veto by the City Commission.
