A RESOLUTION OF THE MIAMI CITY COMMISSION
AUTHORIZING THE CITY MANAGER TO EXECUTE A
DISASTER RELIEF FUNDING AGREEMENT IN A FORM
ACCEPTABLE TO THE CITY ATTORNEY, WITH THE
STATE OF FLORIDA, DEPARTMENT OF COMMUNITY
AFFAIRS, FOR THE PURPOSE OF ACCEPTING FEDERAL
EMERGENCY MANAGEMENT AGENCY ("FEMA") GRANT
FUNDS, FOR REIMBURSEMENT OF EMERGENCY RELIEF
EXPENSES INCURRED BY THE CITY OF MIAMI DURING
AND IN THE AFTERMATH OF THE OCTOBER SOUTH
FLORIDA FLOODS; FURTHER AUTHORIZING THE CITY
MANAGER TO SUBMIT RELATED CLAIMS TO FEMA AND
TO ACCEPT PAYMENTS FOR SAME.
WHEREAS, the October South Florida floods produced
disastrous conditions which had a devastating impact upon South
Florida; and
WHEREAS, said conditions resulted .in the declaration of a
State of Emergency by the Florida Governor; and
WHEREAS, the President of the United States concurred and
declared an emergency (FEMA-13-DR-FL) for the counties of
Miami -Dade, Broward, Monroe, and Collier; and
WHEREAS, the Federal Emergency Management Agency ("FEMA")
has made federal funds available for disaster relief activities
in said Counties.pursuant to FEMA-Ii5DR-FL; and

WHEREAS, the City Manager recommends adoption of this
Resolution which will enable the City of Miami to accept grant
funds from FEMA, through the State of Florida, as reimbursement
for eligible costs incurred by the City of Miami for disaster
relief activities;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE C/TY
OF MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the
Preamble to this Resolution are hereby adopted by reference and
incorporated as if fully set forth in this Section.
Section 2. The City Manager is hereby authorizedi to
execute a Disaster Relief Funding Agreement ("Agreement"), in a
form acceptable to the City Attorney, with the State of Florida,
Department of Community Affairs,. for the purpose of accepting
Federal. Emergency Management Agency ("FEMA") grant funds for
reimbursement of emergency relief expenses incurred by the City
of Miami during and in the aftermath of the October South Florida
floods.
Section 3. The City Manager is further authorized to
submit related claims to FEMA and to accept payments for same.
The herein authorization is further subject to compliance with all
requirements that may be imposed by the City Attorney, including but not
limited to those prescribed by applicable City Charter and Code
provisions.

Section 4. This Resolution shall become effective
immediately upon its adoption and signature of the Mayor.V

If the Mayor does not sign this Resolution, it shall become effective at
the end of ten calendar days from the date it was passed and adopted.
If the Mayor vetoes this Resolution, it shall become effective
immediately upon override of the veto by the City Commission.
