BACKGROUND
The Department of Economic Development is responsible for the site environmental remediation
project being conducted at Civic Towers, an apartment building owned by The Related Group of
Florida ("Related") located at ] 855 NW ] 5th Avenue. Based on assessments conducted in 2003
this property was part of a larger historic, contiguous vacant lot which extended from NW 17th
Street north to the intersection.of NW 15`h avenue and Wagner Creek. Without admission of
liability by the City of Miami, subsequent assessment and remediation activities have been
conducted at the site to satisfy regulatory enforcement requirements associated with the discovery
of buried waste that appeared to be indicative of incineration debris.
The Department has identified the critical need for the proposed improvements due to
requirements under a site remediation plan prepared by PEICO and approved by the Department
of Environmental Resource Management ("DERM"). In addition, strict time constraints for the
project's completion exist, introduced per negotiations conducted with Related. This project will
complete the source removal and the application of appropriate engineering controls at a cost of
$99,977,70 to actively contain contaminated material present at the property. PEICO's current
contract with the City allows it to perform environmental assessments and engineering design
services, the Department is requesting that PEICO be also permitted to conduct the capital
improvements necessary to remediate the property and receive a No Further Action letter from
DERM.
FINDING
The Department of Economic Development finds and determines that it is in the best interest of
the City to waive competitive bids and secure the services of PEICO to complete the soil removal
and the application of engineering controls (pavers, asphalt or clean fill) per the DERM approved
site rehabilitation plan and to also satisfy the necessary time constraints for completion required
by Related's development schedule. PEICO has been conducting assessments at the property
since 12/05- and has performed favorably; thus far they have been ahead of schedule, within
budget and have not requested any claims. This determination is based on our findings that
PEICO is an appropriately licensed contractor and that in this instance, is familiar and
experienced to undertake and perform such work because the firm, a) is currently conducting
assessments at Civic Towers and two other adjacent properties, b) is familiar with the work, the
project and physical conditions at the location, and c) can conduct the remediation in a timely
basis to meet the development schedule of Related, avoiding any possibility of litigation. As
provided in accordance with Florida statutes 255.20 and Section 18-89 & 18-90 (Public Works
and Contracts) of the Code of the City of Miami, we recommend the City Manager affirm and
adopt these findings and forward the matter to the City Commission for its approval.

assimilation of these findings as your own justification for the waiver of competitive bids and the
selection of the specified contractor and engineer.
